Blackhawk Cylinder Latch Problem

My roommate just bought a New Model Blackhawk in .30 Carbine, and it seems to have a cylinder latch problem. When the loading gate is closed, the cylinder rotates freely, and when the hammer is cocked it over-rotates and needs to be manually turned slightly counter-clockwise to line up. It looks like the cylinder latch is not popping up when the loading gate is closed. I don't know much about single-actions but that definitely doesn't seem right. He is planning to disassemble and clean it, but I wanted to see what everybody here thought.
 
So he took it apart, and the cylidner latch plunger seems to be stuck in the frame. It doesn't move at all, so it's impossible to tell if the spring is there or not, but obviously that's why it's not working. Additionally, the hammer is difficult to cock-- it goes about halfway back easily, then has some resistance before you can fully cock it. I don't know if that is normal or not, as I've never owned a single-action. I can only surmise that it might be due to everything not locking up correctly.

BTW, this is a brand new pistol. He's going to call Ruger and see what they want to do, but I imagine it's going to have to go back.
