Just curious, if the stock breaks off your weapon and the overall length is suddenly below NFA standards, are you in violation of the law?

This hasn't happened to me or anything, I just wanna know.
 
Are you suddenly in violation of the law if you take the action out of the stock for cleaning or maintenance? There's some actions that can still fire without a stock. Unless you actually are loading it and shooting it in that configuration, or modify the broken stock to make it usable, they don't care about that. It's called maintenance or disassembly.
 
Considering the guy that just went to jail...

...for a broken AR-15, i would be inclined to say it would depend entirely upon the judgment of the BATFE at the time.

That is not even close to being an honest description of the Olofson case. Further, not only the ATF, but the local cops, the fed prosecutors, and a jury of Olofson's peers didn't see it as simply a case of a "broken AR-15."

Well, depends if you told a freind that the gun was an SBR when you were cleaning it. Then you would have to loan it to a friend who took it to the range and cleaned it there. Then the range guy would have to call the BATF. Then you would be gulity. Ask David about that. :) Otherwise, probably not.
 
I am not a lawyer or BATF agent but I would think that --- YES , you have now got yourself a Sawed Off Rifle/Shotgun.
As the other posted stated ---- it is a Federal Statue for both barrel length and overall length.

Would you get busted for it ?? Maybe ---- but I would think a jury may see it as a broken gun.

Mike the Wolf --------- I'm with ya buddy as to the cleaning . takeing out the action etc. ----- just freaks me out that a few years ago , the Feds decided that IF You Have certain full-auto parts for a firearm you own , even if not installed on a firearm , then you are guilty of owning a full-auto firearm !!!!!
 
Yet another reason to repeal the NFA (or at least SBR/SBS restrictions). I don't want to have to worry about taking the action out of the stock on my SKS to clean it.
