Brother just Died and need legal insight

Hi All,

My brother just died and I know he had a firearms license. Is there any way to search a database somewhere to find out what firearms are registered in his name? I have cut off my relationship with his wife who is a gold digging whoor but she has informed us that the guns have since been taken care of. But we don't know that. Any advice?
 
Sorry for your loss.

California, for example, has a way but I don't know if it can be requested by a 3rd party.

And forgive me for potentially coming across a bit rude, I dont mean to if I am.... but.... what does it matter to you?

They were his, not yours. Unless they were Willed to you or your states inheritance laws specifically bring you into the picture, you dont really have any dog in the fight.
 
Very few states have any type of registration. We need your state. And the personal relationship you have with your sister in law is immaterial to your question on THR.
 
My condolences.

If he lived in a State in which firearms are registered (a distinct minority of States), such information would probably not be readily available, except to law enforcement. Otherwise --

  1. If the brother died with a will and the will is filed in court for probate, the executor of the estate, once qualified, could probably get a subpoena or court order to obtain such information.

  2. If the brother died intestate (without a will) and someone applies to the probate court to be qualified as the administrator of the estate, the administrator, once qualified, could probably get a subpoena or court order to obtain such information.

  3. Depending on the exact situation, there may be other strategies to get the issue into court where one might be able to get a court order to obtain such information.
 
Generally the surviving spouse is in charge of handling the estate. Your brother's widow will no doubt figure things out.
 
Sorry form your loss. Hate to be blunt but sounds like this will end bad. Call her and have a civil conversation.
