Buying an AR receiver or "other" out-of-state?

I know federal law says you can't buy a handgun from anyone except in your home state, but that you can buy a long gun out-of-state if you buy it from a FFL.

What is the status of buying a new AR receiver? What about an "other" like the Mossberg Shockwave?
 
The Shockwave is specifically named as a handgun per ATF, so no on that one. The AR lower, I'm not sure. The sticky wicket there is they are used to build pistols also. As for an actual AOW, that would follow NFA regs; Transfer is between Class III dealers, you pick up at dealer in your state after paperwork and tax paid.
 
You can buy a handgun in another state if you have it shipped to an FFL in your state of residence, or at least I have done so on several occasions and have transferred handguns to my son in another state through his local FFL. No different from buying a handgun from an auction site. I can only speculate about your questions concerning a receiver or the Shockwave, so will await someone who really knows the law.
 
The only type of firearms a dealer can transfer to an out-of-state resident are "long guns", which includes Title I rifles and shotguns. Handguns, receivers, NFA firearms, and "other firearms" like pistol-gripped shotguns and the Mossberg Shockwave all can only be transferred to in-state residents.
 
I know for a fact that handguns from out of state must go through an FFL in your home state.

The AR receiver is just a part and is not considered the firearm for an AR. The lower is the firearm as it has the serial number.
 
Buying everything including the lower receiver parts for an AR is ok. I've had those shipped to myself but anything more than a 80% lower AR receiver must be shipped to your NFL of choice in your home state if it's marked as other or as a handgun. An AR receiver must be shipped to an FFL dealer and be described as a rifle, by that it must not be able to turn into a SBR or handgun. Pretty much I'm going to say I'll cover my butt and have it shipped to a FFL dealer in my home State.
Some folks may do otherwise and not encounter a problem. It's the simplest solution for myself and also sure to be the cheapest as after I pay the dealer for registration of it I won't gave any legal issues arise.

Read the instructions to Question 16 on the Form 4473.

TO ANYONE CHIMING IN WITH "LEGAL" ADVICE...............

Please do five minutes of research before making a post. There really aren't that many ATF regulations, but you have to read them to know what you are talking about.
Heck, reading JUST THE INSTRUCTIONS on the Form 4473 gives a dealer and customer pretty much everything they really need to know.

While you may think it an innocent mistake, an innocent mistake can easily cause another forum member to commit a violation of Federal law. That means they might never be able to possess a firearm again.

To be honest, the first thing I thought when I read this was that if somebody is dumb enough to take advice from an online forum without substantiating documentation they're probably too dumb to own firearms anyway. :confused:

Say what? So all of these major well known online sites selling handguns aren't legal to buy from unless you live in the state the website originates from?

I don't claim to be an expert by any means by that sounds not right.

It is right, I just didn't elaborate. You cannot buy a gun from them directly. You can buy the gun but they can't send it to you. They must ship it to FFL dealer in your state. The FFL dealer then does the transfer to you.

If they sent the gun directly to you then you both would be involved in a federal felony. So to be more accurate: said you cannot directly purchase and take possession of a handgun from anyone in another state even if they are a licensed dealer.
 
Some of the anti-gun TV shows pretend to misunderstand that and deliberately lie in saying that "anyone can buy a handgun on-line or from a magazine ad, no questions asked. They lie by omission by not saying that the gun has to be sent to a licensed dealer in the buyer's state for delivery to the customer and that all state and local laws must be observed.

Note I say "pretend to misunderstand". They know the law but lying suits their anti-gun policy, which is simply to ban possession of firearms by all but a few wealthy and privileged persons (like the owners of TV networks).
