I'm deploying, how can I buy guns in the US while in Iraq

Howdy, folks. It's less than 90 days now. I'll deploy for 7-12 months and I plan on focusing on my family, the bible, and firearms to keep my sanity. Since this is THR, I'll cut straight to the gun related portion. I'll have almost unlimited access to firearms websites but I don't know what I can do while in country. Not to get into too much detail, I should be able to buy a few guns and a grip of cheap practice ammo while I'm in country. My question for you tonight is buying guns while in country. Any handgun will be purchased when I get back. I intend on buying long guns while in country but I don't know how.
Here's what I know:

1. I'll do everything as a North Dakota citizen if legally possible.
2. My father (Sheriff) will take temporary custody of the firearms from the Chief of Police (FFL holder) until I can pick them up and bring them to CA. I don't want to even ask him to think about him getting into legal hot water about the whole matter.
3. I'll mostly be getting MilSurp bolt action rifles. Anything extra (AK's, AR's, M4gerys, Saiga 12's, Saiga .410's) will be covered with my CA out of state military Assault Weapons Firearms tax I will apply for while in country or shortly after my return.
4. I want to purchase firearms from GUNBROKER or http://atlanticfirearms.com/. Anything I can't bring into PRK will stay with my father until I get a new duty station.
5. I want a bolt action, Iron Sighted Milsurp for deer hunting. For PRK it's rather difficult, but what would you recomend for deer hunting in ND?
6. Are there any legal things I'm forgetting that you shuold tell me, or any hints that you should give me?

You have been presented what I know. I might know more and your questions and comments might spur more questions from me. Look for ETA's. I want Milsurps, Sporting weapons, EBR's, Pistols, and everything in between. I know I can't take them all back to PRK but that's not what this thread is about. I want to know about buying long guns online and what I need to do to cover my bases.

To avoid any problems I would have my dad buy the guns and pick them from him when you get back. You place the order with him, pay him the money, they send to his FFL to buy and you pick it up from him when you get back. This is no different than going into a gun shop and doing the same thing and is perfectly legal. So long as you retain ND residency.

Now what to buy....

Were I building a collection of milsurps that I bought sight unseen via the internet with no chance of seeing them before any warranty were up and wanted to hunt deer with them in ND.... I would buy...

- 2-3 SMLE
- 1- 1903 Springfeild (via CMP)
- 3-4 Mosin

A case of surplus ammo in each caliber to just shoot and a few boxes of hunting ammo to zero and hunt with. But that is just me, everybody is different.

My big hint would be to put in for a transfer out of California as soon as I got back from Iraq. The closest I ever came to being stationed in California has been my four trips to Ft. Irwin. I would put in for retirement if they tried to send me out there.

BTW I have much similar plans for my deployment this year.
 
Wow, did I misunderstand your title! I thought Iraqi arms manufacturers were up and running in the mail-order business, and high-roaders could now order their own Iraqi guns. :D

I imagine there would be a booming market in vintage Class III weapons if we could legally NFA them. PPsH's, Thompson's, Sterlings to name a few.
 
I believe that I have seen posts that showed guys in service (thank you for that by the way!) banging away at a range with odds and ends of all sorts of full auto goodness. Not uncles duty guns but local stuff that they came across . Don't know if it was captured guns or stuff that was bought for play while in country.
My guess is that this would vary depending on who you are ,where you are,and what type of job you have over there .
Ask around when you get there , might as well do some playing if you can.
Seems ironic that you are over there trying to save this place and all the full auto toys are available , but as soon as you make it back to this country full auto is very dificult to impossible depending on which state or county you live in.
 
That title sure could be misunderstood. I know I almost did.

I presume you are taking a contract job in Iraq. With that in mind why not save up your pay, per diem, and whatever other $$ bonus’ you get and move out of California when you get back? I am not sure how someone that likes firearms could stomach living in such a restrictive place. Anyway just a thought or an idea.

If moving is not an option. To partly answer one of your questions/concerns about a deer rifle. You can not go wrong with the tried and true .30-’06 caliber. In a bolt gun with a 3-9X or similar power scope you are well outfitted for any and all of the good ‘ol USA.

To those of you who tell me to move: It's impossible. I came from a training command that I worked at for about 2 years to move to a Victor unit (deployable). I've only been with the World Famous Vipers for 4 months and I have to be with them for at least a year to request PCS orders. I am a Marine, not a contractor so I can only move when Uncle Sam tells me to move. This thread is not about buying Iraqi guns found in Iraq. This thread is not about moving out of PRK. I have absolutely no clue how you would accomplish that with it being in your name as you need to be physically present to complete and sign the transaction with your FFL Dealer. I think Titan6 is right that your father would have to purchase them in his name with his signature and do a transfer later to you when you get home.

It's questionable for your father to pick up the guns as that would be considered a strawman purchase. Would there be a problem with the FFL holding the guns until you pick them up?
 
No matter how you order, or from where, the gun has to be shipped to an FFL. Ordering by one person with the gun picked up by another might raise questions.

I think your it would be best if your father developed an interest in those guns, ordered them through your local FFL, and took delivery for his own use. Then, when you come back, if he has something you like and wants to sell it to you, there should be no problem. Your father might even develop enough interest in surplus guns to get a C&R license and build a collection, which might make the process easier for many guns.

Just waiting until you return would be easiest, but for some military folks that return could be a while off.

you have an ffl, thats what the seller needs and thats where the guns will be shipped after you pay for them with your money. If you want them registered in your name , you can have a power of attorney done for your father to handle the transactions in your name.I wouldn't buy anything that wasn't California legal, if thats where you are going to be.
 
Whatever I can't keep in California, I could store at my fathers' residence. It's my legal home of residence and every residence I have while on active duty is considered temporary. Power of attorney looks like the best idea right now...

How about the FFL holding on to the guns till I get back? Is that legal?
 
Yes it is perfectly legal. If you order from the FFL. The only thing is he might not want to hold on to a bunch of guns which is why I suggested the dad hold on to them. (blood being thicker than water and all)

Also as he is your dad it does not fall under a straw purchase rule. Even Sarah Brady bought a gun for her 19 year old son.
 
My spirits are lifted with this info. What information will I have to bring with me to Iraq to purchase these guns? I've only bought guns in person so this online thing, while more convienent, is uncharted waters for me.

Since I can't visually inspect these weapons, what should I do to try to get quality products?
 
why now?

Maybe I'm missing something, but if you are going to be out of the country for the next year and will not be able to use these guns, why buy them now. It would make things a lot simpler for you and your father to wait until you are stateside before buying them. With the exception of Garands which are almost all dried up, all these guns should be available later. They sure aren't running out of Mosins.

I have found when ordering guns on line you roll the dice and take your chances. The exception being CMP who 98% of the time provide the item as described. If the item is new than that is easy enough but whe dealing with relics....

There are many web sites for the various weapons that you wish to purchase that go into detail about what to look for and what to avoid. But since you won't see them I would just have dad inventory them and make sure they are complete and not missing say a bolt.

Doesn't matter who buys it, it you give tehm teh money to buy it for you, it's a straw purchase. Brady's rifle was a gift.

Anyhow, when I was deployed, I had my business partner to the buying with company funds. In your case, if you trust your dad, give him power of attorney (since it sounds like you're not married, would be a good thing to do anyways). He can buy guns, with money in the bank account.
 
This is not too complex.

Have the guns shipped to an FFL of your choice. When you get back to the states, go to your FFL and pick them up.

Due to the fact that the guns will be sitting with the FFL for an extended period of time, it may be necessary for you to have a buddy-buddy relationship with your FFL whereby he doesn't mind holding the guns for you over an extended time period.

It doesn't matter if the person is prohibited or not, it's "follow the money". Read Question #1 on the 4473, and read teh back of the 4473 for better details.
 
I had to go look it up. The ATF arbitrarily changed the rules in 1995 to include anyone and everyone not just prohibited persons. They lost a case in the Supreme Court over the rule change as they were trying to grandfather in a crime. Brady was never charged because it was a "gift".

Oh, and Wikepedia, answers.com and a few others really need some updating they all still have the old "prohibited person's" rule posted... but that is always the case. ATF website = clear as mud.

Given that new rule the dad is now a bad idea (unless the dad has an FFL). Just have the FFL store it for you until you can pick them up.
 
Give your dad LIMITED POWER OF ATTORNEY in writing to act as you in any and all firearms matters.

After its filed with the court he IS you.

I'm sure others on here will fill in the details of that.
