Can the AWB be renewed on 9/13?

"Renewed" is not a good word for what you mean.

It would take an act of Congress, followed by a presidential signature, to "renew" the bill, just like it did when the AWB was first passed.

So in that sense, it could be renewed today, tomorrow, next month, next year, whenever.
 
Sorry, I meant extended. Essentially, I'm a little confused on the exact date of sunset. Some say 9/13 and some 9/14. If the ban sunset 9/13, it would seem that once congress ends session on Friday, the sunset would be a sure thing.
 
The ban is almost guarenteed to sunset- the question is, how long will it stay expired before new legislation is passed.

I believe it expires at 12:00 AM, on the 14th. It could be interpreted to be either the end of the 13th, or the beginning of the 14th, depending on how you look at it.
 
I'm going to put my pre-ban M4 upper on my lower at 11:59:57 PM and see if Agent Smuckatelli shows up. :D
 
IIRC, Congress is only actually in session Tuesday-Thursday. The theory is that this gives them Friday-Monday to go home to their state/district. In an election year, that means they go home and campaign.

So if they stick to their regular schedule, if nothing is done by close of business (which can be quite late at night, especially at the end of a session) on Thursday, Sept 9, the AWB will be a dead law walking.
 
to be more specific, if the current ban sunsets, there wont be a true 'renewal', or 'extension'. entirely new legislation will be devised, and it will definitely be more restrictive than the current one.

we talked about insurance stuff yesterday, so in that same vein, when your insurance policy expires, and you fail to renew it, as far as the company is concerned, when you next pick up a policy, it isnt a 'renewal'. it might be a 'cross-reference' to the old file, but it cannot be a 'renewal' because of the lapse in coverage.

Sweet. That's the kind of info I was looking for. Where can I get confirmation of this? Is the congress schedule online?

I believe it is local time, not eastern time. Somebody correct me if I'm wrong, but I wouldn't want to be the final victim of the law by doing something that violated it just a few hours to early and having the really bad luck of getting caught.

SEC. 110105. EFFECTIVE DATE.
This subtitle and the amendments made by this subtitle--

(1) shall take effect on the date of the enactment of this Act; and

(2) are repealed effective as of the date that is 10 years after that date.

Doesn't that mean that the morning of the 13th the law is gone? (That would explain why the awbsunset site seems to be counting down to the end of the day on the 12th.)

Yes, thats how I read it. The ban expires at midnight when the clock turns from September 12 to September 13.

Basically you can change Paragraph 2 to Read

are repealed effective September 13, 2004.

I guess, depending on how you count 10 years, you could calculate that 10 years from the date it was enacted comes the following day on the 14th. Not sure how the firearms industries lawyers will interpret this language. While I count it to end on the 13th, if I was advising my client, short of an opinion from the Attorney General's office (I will ask for one tomorrow) I would err on the side of caution and tell them to begin selling on the 14th. Of course, for what its worth, as a practical matter no one would ever prosecute someone for a violation on the 13th.
 
Hopefully the President will not issue an Executive Order reauthorizing the AWB. That would suck.

He can issue any executive order he wants, but it will have zero impact. Unless it passes out of the House, Senate, and then Conference before making its way to the White House for signature . . . BEFORE September 13, 2004, it is finished.

And know what - it is. Its simply impossible for that to happen at this point. There just isnt enough time in the four days next week to get it done - and with the far more pressing need to pass appropriations bills, no one will even be considering this (let alone have time to consider it).

Good point - but it won't make it out of conference with those riders attached.
 
If "W" tries to issue some type of Exec Order, request, suggestion, etc for the renewal/reauthorization or passing of new legislation, I WILL vote Libertarian. Bye Bye Republicans. (CINO - conservative in name only)

If Kerry wins I'll bet the farm we'll have some sort of AWB within the year.

Remember Kerry is a hunter, not a shooter. He hunts deer crawling around on his belly with a double barrel shotgun. :rolleyes:
