Followup to locked thread on LEO shoot.

Jeff narrowly defined the scope of discourse. The issues he wanted to discuss naturally invoked other issues. Conversations ebb and flow.

Applicable lessons in a civilian scenario? Hire an attorney capable of explicating the shooter's fear of harm. The man feared for his life when he fired the shots.
 
He may have feared for his life, but his action in shooting did nothing to deal with the cause of that fear. Shooting would not/did not stop the threat. If the truck, instead of moving, had burst into flames, a reasonable man would have felt fear; but would he shoot? Shooting a fire will not stop it anymore (or less) than shooting a moving vehicle.
I think he shot because he was angry (and afraid), he wanted to punish the driver, and had an excuse to do it. He shot, and THEN moved out of danger.
