Clarification on Pistol Permit Applications in NY

Some of you guys see me talking about it, and some are generally confused, some have PM'd me and asked me questions regarding it, so I figured I'd copy some information from the Permit book. Mods, wasn't sure where exactly to put this so please move to where necessary. The application costs $10 to get and you have to go to the main court in White Plains to get it. Spells out a bit of information about NY Laws. Packing.org only has a form online for Sullivan County so I figured putting some of this out there would help those who are fortunate enough to not have to deal with this, understand what some of us from NY are talking about

Minimum Applicant requirements

a) Be an applicant concerning whom no good cause exists for denial of such license

b) Be at least twenty-one (21) years of age or older, except that where the applicant has been honorably discharged from any branch of the United States armed forces, or from the National Guard of the state of New York, no such age restriction shall apply.

c) Be of good moral character

d) Have no prior conviction for a felony or serious offense (P.L. 265.00-17)

e) Be free from any mental disorder, defect or disease that would impair his/her ability to safely possess or use a firearm.

f) Disclose any prior history of or treatment for mental illness, or any related condition

g) Never had a firearm license revoked, or who is not under suspension or ineligibility order issued pursuant to the provisions of section 530.14 of the Criminal Procedure Law or section 842(a) of the Family Court Act.

h) Successfully complete a firearm safety course and test as evidenced by a certificate of completion issued in his/her name and endorsed and affirmed under the penalty of perjury by a duly authorized instructor (P.L. section 265.00-19), except persons who have been honorably discharged from the armed forces of the United States do not have to meet this requirement (Must produce discharge papers)

i) Reside or maintain a principal place of business within the confines of Westchester County

j) Have no prior conviction of a misdemeanor crime of domestic violence

k) Be a citizen or a naturalized citizen of the United States, or a registered alien

Specific Applicant Requirements

Below is a listing of the specific requirements that each applicant must meet for each class of firearm license. If you do not meet the requirements for any specific class of firearm license, do not apply for the license

(a) Premise Dwelling:

(i) Documentation showing the address or location of the dwelling that will be the subject of the premise dwelling firearm license

(ii) Documentation showing that the applicant resides in the dwelling that will be the subject of the premise dwelling firearm license. The applicant must live in the residence on a primary basis. This may be shown by the submission of rent receipts, utility bills, or other acceptable documents




(b)Premise Business:

(i) Documentation showing the address or location of the business that will be the subject of the premise business firearm license. This may be shown by the submission of real property deed, business license, municipal tax documents, or other acceptable documents

(ii) Documentation showing a legitimate building establishment. This may be shown by the submission of municipally issued business license, business records or other acceptable documents. If the applicant is operating a business from inside a residence, he/she must submit proof from the local municipality indicating that the business operation is consistent with local laws.

(iii) Documentation showing that the applicant actually works at or is employed at the business establishment that will be the subject of the firearm license. This may be shown by the submission of payroll or income tax records or other acceptable documents.



(c) Sportsman License: Target Shooting

(i) The application and support documents must establish proper cause for the issuance of a firearm license for the express purpose of target shooting . Proper cause means that the activity is to be conducted by a sportsman on a regular basis over a sustained or prolonged period of time.

(ii) The applicant must provide the name, address and location of all facilities or open land where a firearm is expected to be used for the purpose of target shooting as a sportsman.




(d) Sportsman License: Hunting

(i) The application and support documents must establish proper cause for the issuance of a firearm license for the express purpose of hunting with a firearm. Proper cause means that the activity is to be conducted by a sportsman on a regular basis over a sustained or prolonged period of time

(ii) The applicant must provide the name, address or location of all open land where a firearm is expected to be used for the purpose of hunting as a sportsman




(e) Bank Courier / Express Messenger:

(i) Documentation showing the address or location of the bank/express messenger service that will be the subject of the bank/express messenger firearm license. This may be shown by submission of business related documents, business license, real property deed, municipal tax documents, or other acceptable documents

(ii) Documentation showing a legitimate building establishment. This may be shown by the submission of municipally issued business license, business records or other acceptable documents. If the applicant is operating a business from inside a residence, he/she must submit proof from the local municipality indicating that the business operation is consistent with local laws.

(iii) Documentation showing that the applicant actually works at or is employed at the business establishment that will be the subject of the firearm license. This may be shown by the submission of payroll or income tax records or other acceptable documents.

(iv) Documentation showing the locations where the applicant works travels or makes deliveries





(f) Employment Carry

(i) The application and support documents must establish proper cause for the issuance of an employment carry firearm license. Proper cause means that due to unusual employment related circumstances the applicant has a special need for self-protection or possession of a firearm distinguishable from that of the general public

(ii) The below list of factors may assist you in the establishment of proper cause for the issuance of an employment carry firearm license. This list is provided for illustrative purposes only and is not meant to be all inclusive. You should understand that the mere fact that you are employed in an area known for criminal activity or that you routinely carry money or other valuables does not by itself establish proper cause for the issuance of this class of firearm license:

(aa) A full and specific explanation of the unusual employment related circumstances which require a special need for self protection or possession of a firearm distinguishable from that of the general public.

(bb) A letter of authorization or necessity from your employer establishing a need for a firearm during the course of employment

(cc) The production of any document or record which establish unusual employment related circumstances which require a special need for self protection or possession of a firearm distinguishable from that of the general public

(iii) Documentation showing the address or location of the bank/express messenger service that will be the subject of the bank/express messenger firearm license. This may be shown by submission of business related documents, business license, real property deed, municipal tax documents, or other acceptable documents

(iv) Documentation showing a legitimate building establishment. This may be shown by the submission of municipally issued business license, business records or other acceptable documents. If the applicant is operating a business from inside a residence, he/she must submit proof from the local municipality indicating that the business operation is consistent with local laws.

(v) Documentation showing that the applicant actually works at or is employed at the business establishment that will be the subject of the firearm license. This may be shown by the submission of payroll or income tax records or other acceptable documents.

(vi) Documentation showing the locations where the applicant works travels or makes deliveries





(g) Employee of Corrections

(i) The application for license must be made by the administrative head of a correctional facility on behalf of the employee who is seeking a firearm license. Administrative head includes a commissioner, warden, superintendent, head-keeper or any person performing such function. Sufficient documentation must be provided showing the applicant is, in fact, the administrative head of a correctional facility.

(ii) Documentation showing address or location of the correctional facility that will be the subject of the employee of corrections firearm license. This may be shown by the submission of real property deed, municipal records or other acceptable documents.

(iii) Documentation showing that the applicant actually works at or is employed at the correctional facility that will be the subject of the firearm license. This may be shown by the submission of payroll records, tax records, or other acceptable documents.

(iv) Documentation showing the location where the applicant works travels or guards prisoners





(h) Justice of the Supreme Court 1st or 2nd judicial department, or judge of NYC civil or criminal court:

(i) Documentation showing that the applicant holds or has been assigned to hold a current term as a justice of the supreme court 1st or 2nd judicial department or as a judge of the New York City Civil or Criminal Court





(I) Full Carry:

(i) The application and support documents must establish proper cause for the issuance of a full carry firearm license. Proper Cause means that due to extraordinary circumstances and/ or extreme danger , that applicant has a special need for self-protection or possession of a firearm distinguishable from that off the general public.

(ii) The below list of factors may assist you in the establishment of proper cause for the issuance of an employment carry firearm license. This list is provided for illustrative purposes only and is not meant to be all inclusive. You should understand that the mere fact that you are employed in an area known for criminal activity or that you routinely carry money or other valuables does not by itself establish proper cause for the issuance of this class of firearm license:

(aa) A full and specific explanation of the extraordinary circumstances and/ or extreme danger to which you personally are exposed requiring a special need for self-protection or possession of a firearm distinguishable from that of the general public

(bb) A full and specific explanation of all threats that have been made against you personally by any person, or an explanation of threats that have been made against other persons under circumstances which are identical to your own.

(cc) The production of any document or record which establish an extraordinary need for self protection or possession of a firearm and/or extreme danger distinguishable from that of the general public






(j) Full Carry: Retired Police or Federal Law Enforcement Officer

(i) Documentation establishing proper cause for the issuance of a full carry firearm license as a retired police officer (C.P.L. 1.20-34) or retired federal law enforcement officer (C.P.L. 2.15). Proper cause means that the applicant has retired or will retire within a reasonable period of time, from active duty service as a police or federal law enforcement officer and who as part of his/her official duties carried or qualified with a firearm and maintained such employment in good standing

(aa) The applicant must supply a letter from his/her former employer on agency letterhead establishing his/her status as retired peace officer and satisfactory assignment with a firearm




(m) Gunsmith

(i) Documentation showing the address or location of the business establishment or enterprise that will be the subject of a firearm license as a gunsmith. This may be shown by the submission of business records, municipality issued business license, real property deed, or other acceptable documents

(ii) Documentation showing a legitimate business establishment. This may be shown by the submission of municipally issued business license, business records, or other acceptable documents. If the applicant is operating a business from inside a residence, he/ she must provide proof from the local municipality indicating the business operation is consistent with local laws

(iii) Documentation showing that the applicant actually works at or is employed at the business establishment that will be the subject of the firearm license as a gunsmith. This may be shown by the submission of payroll or income tax records or other acceptable documents.

(iv) Documentation showing that the applicant is proficient in the repair, alteration, assembly, manufacture, or other mechanical operation of firearm(s) as a regular course of trade or business. This may be shown by the submission of trade documents, training or proficiency records, business license, or other acceptable documents.





(n) Firearm Dealer:

(i) Documentation showing the address or location of the business establishment or enterprise that will be the subject of the firearm license as a dealer. This may be shown by the submission of the business records, license, or property deed.

(ii) Documentation showing a legitimate business establishment. This may be shown by the submission of municipally issued business license, business records or other acceptable documents if the applicant is operating a business from within a residence, he/she must submit proof from the local municipality indicating that the business operation is consistent with local laws

(iii) Documentation showing a current valid Federal Firearms License


(o) Antique Pistol
(i) Documentation establishing that the applicant has a substantial and sustained interest in the collection of antique firearms

(ii) Documentation showing the address or location where the antique firearms will be stored

(iii) Documentation showing the method of storage of antique firearms.



Those are the licenses you can get. Meaning, if I'm caught in a restauraunt with my pistol locked up in my car, all I have is a target permit, I'm in trouble be cause i'm not heading too or from a pistol range. Now, those are just the ammendments for the permit, not the actual application process. In the packet with the nice book I copied the above out you get the following

Pistol License Application
NYS Mental Hygiene Release Form
Authorization for the release of personal information form
Firearm Character Reference form (4 of these)
List of certified safety instructors
NYS pistol/revolver liscense application (form PPB3/PPB3A) (3of these)
and attachments.

Application forms and attachments must be typed or printed in black ink and must be signed and notarized 30 days from date of issue. Forms must be submitted in triplicate.

Each applicant must submit 4 identical photographs of him/herself without sunglasses or a hat showing full front view of the face. Must be 2 inches by 2 inches in size. You must attach 3 photos to the originals with glue and submit the 4th loose. Photos must have been taken within 30 days of date of issuance of forms

Provide proof of citizenship and legal residence within Westchester county. Birth certificate, naturalization papers, Passport, or resident alien cards are acceptable. Residence must be shown by submission of voter records, utility bills.

Must disclose all previous arrests, criminal charges and convictions, including those dismisses.

Must submit four (4) character references. People completing notarized references may not be related to the applicant in any way and must have known applicant long enough to establish good moral character.

Submit proof of a firearm safety course

Processing times takes 6 months.
 
this looks slightly different from the delaware co requirements, so i'm assuming this is only the westchester co permit book?

also, i was just going to post in l+p, as i found on the nra sight a summation of nys gun law that states,

Applications for licenses must be acted upon within 6 months after presentment. If there is a delay, there must be written notice to the applicant stating the reasons. Such delay may be excused for good cause only.

would anyone know the actual statuate that is governing this? it seems the actual processing time in delaware co is more like 8 months, and i would like to be able to point out the exact law governing this. in this county it seems the delay is due to the sherriffs dept. according to the above link it seems the licensing officer should have total discretion.

The determination whether to grant the license is completely within the discretion of the licensing officer.

it even goes on to say that

An investigation will be conducted regarding all statements required in the application. This includes taking the fingerprints and physical descriptive data of the applicant. One copy of the fingerprints will be forwarded to the FBI for a search of the applicant’s criminal records. The failure or refusal of the FBI to make the fingerprint check shall not constitute the sole basis for refusal to issue a permit.

it seems the investigation should only be to verify my statements on the application. the licensing officer even appears to be able to issue even if the fbi refuse to do their check.

again if anyone knows the actual laws that this condensed version represents i would appreciate you posting it.

Yeah,I think it varies alot from county to county.Some people have to actually go before a judge even for an amendment.Some wait a week,some get one the same day.I live in a good county....

Yep, NY pistol permits are county specific. The ease of obtaining a permit varies with your local. I'm lucky enough to live in niagara county where full carry permits are given in ~ 60 days:)
