clarification on sale of stripped AR lowers to non-resident

any ffl's out there who can clear this up?

i am a resident of X.

i want to go to an ffl who is in nearby state Y.

can i legally buy a stripped AR lower from him?

i am over 21.

p.s. if anybody is asking why, new 4473's have been distributed to FFL's recently. stripped lowers are now booked as "other" category as distinct from long gun or handgun.
 
Yeah that "other" category is going to be interesting. I suspect the ATF will reverse itself on that one.

My guess now, not a lawyer and all that, is intent. If you intend to build a rifle with it you are OK. If you intend to build a pistol you are not.

That's just my wild guess. I suspect ATF will clarify that to FFLs soon, I bet many of them are asking the same question.
 
As I understand you can buy the rifle lower but if it were designated pistol then you would have to buy within your state.
My question to add would be can I make a rifle from a pistol lower?
 
No out of state Sales of lowers

Spoke to BATFE inspector out of the Louisville Ky industry operations office. Stripped lowers and for that matter any action only, whether rifle pistol or shotgun you must be an instate resident and at least 21 years of age. So no, you may not purchase a stripped lower in another state. She said this has largley not been enforced but the BATFE will now sart enforcing it. For instance we have been told by BATFE for years that pistol grip shotguns buyers had to be in state and at least 21 this is just further interpetation of the rule. She said this falls under the Gun Control Act of 1968. She said that the GCA 68 says that rifles and shotguns can be sold to 18 and over and out of state as long as the rules of both sates are followed ( yes I know the FOPA act ammended the rule about connecting states). But the GCA 68 says that all other firearms, not just handguns, must be in state and 21 and over to purchase. She also said that they would not be going back and looking at sales in the past and that FBI/NICS would not issue a transaction number when the customers state of residence did not match the store's state if either the handgun or other firearm box on the 4473 was checked ( and stated to the NICS examiner) when the background check was called in.
 
You can only buy rifles and shotguns outside of your state of residence. All pistols and other types of firearms (stripped lowers, NFA items, etc) need to be transferred through an FFL in your state of residence.
