Court rules against environmentalists seeking EPA regs for lead bullets

A federal appeals court has ruled against environmentalists who are trying to force the Environmental Protection Agency to regulate spent lead bullets and lead shot used in hunting and shooting sports.

In a decision favorable to gun enthusiasts, the U.S. District Court of Appeals for the District of Columbia Circuit said Tuesday that environmental groups have suggested no way in which EPA could regulate spent lead bullets and shot without also regulating cartridges and shells.
 
The enviroterrists have been shot down on this a number of times in recent years. Eventually, I hope, they will run out of courts to file this in.
 
They can't win this because the federal law explicitly exempts ammunition. Every time that try they'll get shot down unless the law changes.
 
Do you think this ruling will have any effect on gun ranges? I know some that have halted expansion plans due to lead remediation rules. It's expended ammo, right?
 
As previously noted this has been litigated up and down for both the firearms side and the fishing industry (the fishing industry has fought this successfully at least twice in the last twenty years - and at great expense...) and the good guys have won (eventually) every time... That said, you can expect addtional assaults from different tangents since the folks determined to slow/stop/outlaw every aspect of firearms usage won't be quitting anytime soon.

Here's what I would expect in the future... at the state level a push for laws regarding "health risks" posed by lead in all it's forms.... Yes, lead is a poison and it does need to be carefully dealt with in any environment -but the kinds of stuff I'm talking about will come under that disguise but will be intended to have a very different result.... I can see attempts to prohibit any ranges near residential areas, etc. The second tack will be towards "raising funds to deal with environmental impacts" but will have a lot more to do with raising the costs at every level for the shooting sports by specific user taxes...

As you can see, paying attention to what our opponents are up to is probably a good idea for the future. I'd consider it a form of "Pest Control" and have long advocated that approach for outfits like PETA as well....
