Curiosity About Current Maryland Handgun Laws.

I don't know why I got to thinking about this but I have a couple of questions regarding the current FUBAR handgun laws in Maryland. I used to live there so I have some understanding of the laws and climate but left before the handgun lock law etc.

Anyway I have two questions regarding the integral lock law.

1st) How does the law effect me as a TN resident when I come home to visit Maryland. Can I lawfully bring a firearm without an integral lock that was made after 1/1/2003 but was legally purchased by me in another state?

2nd) How does the law effect people who may move into Maryland from other states and have firearms that they lawfully purchased in their previous state that have no integral lock and were manufactured after 1/1/2003.

Basically is the law worded so to say that handguns cannot be transferred or sold or is it worded to say they cannot be possessed? What about those with dual residency in a bordering state. Let's say you have homes in PA and MD. You buy your handguns in PA, any laws about possessing them in MD?

Just a thought.

From what I understand (and I am not a lawyer), the only firearms that cannot be brought into the state are "assault pistols" like the HK SP89, the Mac-XX series, etc. Everything else you can bring in, but you might not be able to sell or transfer the firearm.

As of now, that is correct about bringing in guns, but the anti-gun crazies are trying to essentially bring all semi-auto rifles under the same ban as "assault pistols". I don't know if we have a chance or not, as the governor we worked to elect may chicken out and trade our gun rights(?) for his slot machine bill. Or there may be another sniper attack, by "pure coincidence" of course, while the bill is being debated.

As to what an individual can bring in on a visit, the lock law only affects dealer sales. But you will be taking a chance if you carry the gun or have it in a car where you can get to it. Locked in trunk is OK if you are going somewhere you can legally shoot, like a range or a relative's back yard. But try not to violate any driving laws and make sure there is no ammo or any gun accessory in sight. Not only magazines (as in pistol) but magazines (as in printed matter) have been construed as probable cause to search for illegal weapons.

Some months ago when I was there (at the MD State Police barracks) anyway to transfer a gun I was selling (the CZ 40B) I asked about this. I figured I may eventually move out of here but there is always the chance I would return and I was curious what the deal would be if I did.

Well, the law is about sales not possession. If you bought the guns legally you can have them (at least with current law). So if for some reason you will return, buy up all the non-lock guns you can find. The only thing is, since even private sales go through the State Police and are subject to all MD laws, you would never be able to sell them while in this state.

I got this info from one of the detectives in the department that deals directly with gun laws so my guess is that he'd know better than anyone what is legal and what isn't.

Has Maryland set up gates and check points at the borders yet? I think that would be the next logical step. Perhaps the U.S. should once again be divided. We will have some states that are under Communist rule and the rest will be under free Democratic rule. If you think guns are evil, move into a Communist state and let the government take care of your every need. If you feel that the U.S. Constitution and Bill of Rights is the way to go, then you would move into a free state. I think this would also help in rounding up all the criminals, they would migrate to the Communist states where the pickin's would be easiest.

While the law focuses on the sale of handguns, it prohibits the sale of handguns manufactured after 12/31/03 without an internal lock. If you can prove it was made before that date you can resell it. A copy of the original purchase receipt dated before 12/31/03 will usually suffice. Often a manufactuer will provide a letter certifying date of manufacture for a nominal fee. Some gun dealers will use the common sense rule (i.e., that USGI Remington Rand 1911A1 was obviously made a while ago.)
 
Ugh. How can I convince my better half that we need to leave this state. She does not want to be far away from her family. I don't think PA or VA are that far away.
 
How ironic: Maryland's official nickname is "The Free State."

If you look at the new quarters - We"re the Old Line State. Whatever that means it's more appropriate than the free state.

Show up on Tuesday if you have any interest in gun rights in MD, if not don't whine when they take them away. There are at least 5 related threads in Legal and Political.

MrPink, I'm confused as to why you addressed that to me. I am aware of the law that for a handgun to be sold in MD that was made on or after 1/1/03 (not 12/31/03 as you said but a year earlier which is what I think you meant) that it must have a built-in lock. I didn't mention that because it was already stipulated in the very first post in this thread. CSlinger was asking about whether or not he could bring guns he bought while a resident of another state into this state (say, if he moved back to MD) even if it was a post 1/1/03 gun without a built-in lock. I answered his question accurately. If he bought it legally in a state he lived in at the time he can bring it here, but if it was a post 1/1/03 gun he won't be able to sell it within the state as a used gun.
 
Hi, Hey don't joke about crossing over to Maryland border as a check point ! Have any of you travelled from Sheperdstown, Wv to Sharpsburg, Md lately . Becuz of the bridge project the speed limit is 20 mph . Cop from either state is there every day getting the speeders . I do 20 ! Could be worse , could be Ny................WVleo
