I realize we only have one side, and that there is a lot more info that would be helpful to know. Regardless, on the face of it, this is all kinds of ludicrous.

How did someone who passed background and medical history checks get the shaft, while a knife wielding miscreant is given the benefit of the doubt?

Can anyone shed some light, or give any kind of insight into whats going on here?

I have to side with the guy here. Some of the biggest crooks are cops.

I heard this story ages ago and nothign has happened and no one has gotten any lawyers.

Something smells wrong.

Either this guy is getting completely screwed by the police or he isnt being completely honest about whether or not he had a concealed carry permit at the time.

I dont get why this is still going on. This seems like the most clearcut case of "guy accused of paperwork crime when there should be abundant computer proof that he didnt commit the crime." Or does PA simply not record any of its CCWs anywhere?

Read the LJ post AND the comments. The poster says that he DID get a lawyer and actually names the lawyer. He gives the date for his upcoming prelim exam as well.

The poster also says that he did NOT explain to the police what happened at the time. It's not that the police took the homeless person's word over the CCW holder's word, it's that the police only heard one side of the story. The poster said he decided NOT to answer questions without his attorney present and that the police "had no interest" in questioning him once he had his attorney.

As far as the timeline goes, the first post was in March. He said his prelim exam was scheduled for June. That does sound about right.

I think it happened. There may be more to it then we know, but I don't have any reason to doubt the poster's general account.

Exactly what we talk about at THR. For you that came in late from this remember:

1) two boxes on the police report--victim and perpetrator. The first one to call gets to be the victim, call the police!

"If no one sees you, just walk away" is macho bearthread for the gun shoppe. Don't be a moron call the cops.

2) Eddie Haskell up around cops. Don't look bad at your hearing/trial, act like an innocent man.

3) cops do and will destroy exculpatory evidence. They do it every day, you CYA.

Hope he gets a lawyer that screams bloody murder over this.

I don't know if the story is far-fetched or not. I'll take him at his word.

I never thought about making a digital photocopy of my LTC. Think I just might at work tomorrow (color copier).

All that said:

1. His first mistake was NOT calling the cops IMMEDIATELY after drawing his weapon, shots fired or not.

2. I also hope his attorney screams BLOODY MURDER, and his guns, permit, and rights restored appropriately.

It's only been rumor to me, but I have heard that Philadelphia's mayor is quite anti-gun and loves using responsible, law-abiding gun owners and CCWers as pawns in his "political games". :fire: :cuss: :banghead: :barf:
