I have a trust for my NFA items. The trust was drafted by a lawyer in PA and includes myself, parents, and siblings on it as trustees. We all lived in PA at the time the trust was drafted so our addresses are PA addresses on the trust. I am in the military and am now stationed in NC. Am I able to use the trust, without amending it, to purchase NFA items in NC? If so, what is the process and things I need to be aware of? My concern is that if I buy from an NC dealer that either the dealer or ATF will become confused or return the tax stamp application because they’ll see PA addresses in the trust, but I am buying from an NC dealer. I want to remain legal, but I prefer not having to pay for a new trust or to have the current trust revised.
Please don’t guess or provide assumptions or provide cop out answers like “just get another trust.” Please address the question of whether the existing trust can be used to legally purchase items in NC.
