FFL required for firearm when return from factory repair?

So when I ship firearm to factory for repair, do they have to ship it back to a FFL after repair or can ship to my house? It is already transferred to me once, really see no reason to pay and transfer thru FFL again. What is the practice and rule?
 
The factory can ship it back to you.

No FFL fee involved.

Just be sure there is someone there to sign for it when it comes home.

ATF regs allow for the direct return of a repaired OR REPLACEMENT firearm (of the same model).

Not all gunsmiths/repair centers/manufacturers will return directly to the owner.

Yes and no.
A replacement firearm will be required to be transferred through a FFL. I just went through that one. Because a replacement firearm will have a new serial number, it will have to be recorded in a FFL's bound book and will require a form 4473 be filled out. Transfer fees will vary from FFL to FFL.

If the firearm was repaired by the MFR, it can be shipped directly to the owner from which it was shipped.

Read the ATF regulation:
§478.147 Return of firearm.

A person not otherwise prohibited by Federal, State or local law may ship a firearm to a licensed importer, licensed manufacturer, or licensed dealer for any lawful purpose, and, notwithstanding any other provision of this part, the licensed manufacturer, licensed importer, or licensed dealer may return in interstate or foreign commerce to that person the firearm or a replacement firearm of the same kind and type. See §478.124(a) for requirements of a Form 4473 prior to return. A person not otherwise prohibited by Federal, State or local law may ship a firearm curio or relic to a licensed collector for any lawful purpose, and, notwithstanding any other provision of this part, the licensed collector may return in interstate or foreign commerce to that person the firearm curio or relic.

Since this regulation references 478.124a:
§478.124 Firearms transaction record.

(a) A licensed importer, licensed manufacturer, or licensed dealer shall not sell or otherwise dispose, temporarily or permanently, of any firearm to any person, other than another licensee, unless the licensee records the transaction on a firearms transaction record, Form 4473: Provided, That a firearms transaction record, Form 4473, shall not be required to record the disposition made of a firearm delivered to a licensee for the sole purpose of repair or customizing when such firearm or a replacement firearm is returned to the person from whom received.

Yes.
Both of my Yugo M59 SKS were sent to Murray's (Gunsmithing) from here in TN, to permanently cure the serious popped primer issues.

Both were legally shipped directly to my home after each 'cure'.

SIG will. I've done it twice -- once for warranty repair and once for "elective surgery." ;)

IIRC, they want more than just any adult signature: it has to be the signature of the addressee.
 
From personal experience I have to agree with dogtown tom. I sent a S&W in for repair after talking to them. They took about a week and said that there was some defect in that gun and how would just like a new "improved" one? OK sounds great to me. The next morning Fed Ex shows up and my wife signs for it. No FFL, her signature was fine. It has a different serial number. I got a new M&P and S&W even threw in a couple extra magazines. They paid for the shipping to them and back.

I think that a lot of companies want to save on shipping costs so they give you the FFL BS. It is MUCH cheaper to ship from FFL to FFL. It doesn't have to go overnight. The last I checked it was around $80 overnight UPS and about $75 FedEx. Two or three day, peanuts.
From personal experience the answer is just YES.
 
In NC if it goes to a dealer there's no transfer as long as it was entered in the repair log when you sent it out.
 
About 6 years ago I shipped a revolver back to Taurus, they repaired the faulty piece and sent it right back to me within a week. Even gave me a new box.

Well sort of. FFLs can *mail* handguns which is indeed a lot cheaper than UPS Overnight. But it doesn't make any difference whether the recipient is an FFL or not.
 
I get you but I don't really trust the USPS to deliver my mail, let alone a gun. I know my FFL gets them fast (2 days) and they don't charge me shipping. I know sending a gun back to Davidsons was MUCH cheaper going through my FFL. The CEO thanked me.
 
I've found USPS to be at least as reliable as UPS or FedEx. It is cheaper and more convenient

Nope, it costs exactly the same.
UPS/FedEx/USPS websites have no idea that the address I'm shipping to is an FFL.

All the UPS and FedEx policies regarding firearm shipments apply exactly the same to gun dealers as they do to everyone else.

yugorpk Having LOST a couple of rifles in the US mail I tend to disagree with you.
Having never lost a shipment through USPS I tend to disagree with you. :D

I receive 2000+ guns a year: 50% are USPS, 40% UPS, 10% FedEx.

90% of the problems are with FedEx Ground.
