Long Guns Recently Turned In at Phoenix event in May, 2013

There will be two gun turn in events on 27 July, 2013 in the Miami, Florida area.. While these events are commonly labeled with the propaganda term "buyback" the guns were never owned by the people attempting to buy them.

One event will be held in North Miami at 15045 Biscayne Blvd at the Biscayne Landings sales office. The other will be held in South Dade at 11350 SW 216 St. Both events will run from 10 a.m. to 2 p.m.

Gift cards valued up to $200 will be exchanged for firearms. People are supposed to be able to turn in firearms "no questions asked". Police usually check firearms to determine if they are stolen, but no statement to that effect has been found for this event.

As these events will be occurring near the end of the George Zimmerman trial, they will have additional interest.


Across the country, communities, police departments and churches are sponsoring gun turn-ins to get "guns off the street". At many of these events, private buyers are showing up, offering cash for the more valuable guns. These private additions to the public turn-in are effective, no doubt, in getting more guns off the street, because they add to the resources that are available to those who want to get rid of guns for something of value, be it a grocery card or a number of twenty dollar bills.

You can help make the turn-in in your area more effective by standing on the curb with your "Cash for Guns" sign, or at a folding table, willing to offer more than the gift card for firearms that are more valuable. It would be best if numerous private parties were available, as more good guns could then be transferred into responsible hands.

This action serves many useful purposes. It stretches the turn-in budget so that more guns can be taken off the street. It helps keep fearful widows from being defrauded of most of the market value of the gun they are turning in. It prevents valuable assets from being destroyed by bureaucratic inflexibility. It is a win-win-win situation.

It also dispels the pernicious message that guns are bad and should be destroyed.

Private sales are legal in Florida. Open carry of firearms is generally not legal, but it appears that brief displays of a firearm are accepted, if the display is not in a threatening manner

Great idea, but what if they are turning in a valuable stolen gun or one used in a crime?
 
Disappointing addresses. One is much too far away, and the other is in the middle of a neighborhood I'm uncomfortable with.
 
If that buyback is anything like the recent Phoenix ones, Iramo, the turn-in locations will be the safest places in the state thanks to the number of open-carrying gunnies there to buy. :)

FDLE has an online stolen firearm database that can be checked.

As for guns used in crimes, it's no different than any other sale. No way for anyone (including LEO) to tell if a guns has been used in a crime. Unless, of course, it was recovered at the scene or taken from a suspect - but then it would not be available to sell.
 
As much as I hate buybacks I also don't want anyone to get in trouble. All sales conducted on property where the public has the right of way in Broward,Palm Beach and Dade counties require a criminal backround check and a waiting period.http://en.wikipedia.org/wiki/Gun_law...#Firearm_sales

For the right gun, that would not be a deterrent. I'd go to an FFL to get a gun I really wanted at buy-back prices. It would be even better if an FFL or two showed up at one of these events for the sole purpose of facilitating these transactions

Having a concealed carry permit could be quite advantageous in this case.
 
Well, at first I thought I had more reason to hate my home counties of Broward and Miami-Dade at the possibility of not being able to take advantage of this. So I looked it up!

It does indeed say that Carry Permit holders are exempt... now on to municode. FYI almost every decent size city has their codes online via municode. It's very handy! I used this in school for zoning regs.

There you go! Anyone can buy the guns. Make a huge sign and bring $$$. I'm moving back in two weeks and might make the North Miami one if I can spare funds.
 
Please do so. If you could take some pictures, especially of guns being offered, sold, or turned in, it would be great.

If you could send me a report and or pictures, I would be happly to write it up and post it. We seldom get firsthand reports of these events, so it would be very helpful.
 
If it were closer to me I would go, but 4 hours plus standing around, with a bad back is torture. I would love to know when they have one in Palm Beach or further north.

Well, the source is wrong, because Pinellas, Hillsborough and Volusia also have similar ordinances. (I still recall their being one more, but my memory is not as good as it once was.)
Although I read a story a week or two back that Volusia was considering repealing theirs.
 
Okay I hate to keep yanking people's chain around BUT...

I did remember what brboyer is talking about. A bit ago the NRA sent out a email alert for a Tampa area gun show. The alert was that they had a regulation on the books for a wait period and background checks that would apply for gunshows. The local LEO apparently had no clue and wasn't enforcing it. In all the recent hoopla someone alerted him to it and he talked about enforcing it. I don't know if he did or not.

So I looked up some stuff again... I'm getting really good at the codes now...

The preemption law is:

"790.33 Field of regulation of firearms and ammunition preempted.—
(1) PREEMPTION.—Except as expressly provided by the State Constitution or general law, the Legislature hereby declares that it is occupying the whole field of regulation of firearms"

So what's in the Constitution at Article 8 Section 5 (http://www.flsenate.gov/Laws/Constitution#A8S05):

(b) Each county shall have the authority to require a criminal history records check and a 3 to 5-day waiting period, excluding weekends and legal holidays, in connection with the sale of any firearm occurring within such county. For purposes of this subsection, the term “sale” means the transfer of money or other valuable consideration for any firearm when any part of the transaction is conducted on property to which the public has the right of access. Holders of a concealed weapons permit as prescribed by general law shall not be subject to the provisions of this subsection when purchasing a firearm.

SO WHAT THE JUNK... apparently the only thing a locality can do is the 3-5 day wait and background check when a sale is done in a public area. The carry permit exempts the buyer.

But from what I saw earlier Miami-Dade has pulled that section out of their codes. I also haven't gotten alerts or heard of this being an issue in Miami-Dade with gun shows. I'm going to investigate more and see who exactly is running the "buyback" and if it's Miami-Dade cops that will be there and ask them what's up.

Either way I have my carry permit and I should be fine. I'd be more worried about LEO's not liking it, but I can deal with that. I'll cover my butt.
 
This is a great idea. I don't have my CWP yet otherwise I'd attend. Please post pictures and notify us. Heck, some YouTube videos would be great as well.

We could make some good money... Buy them, list them on ArmsList at 25% under market value and rake in the profits... :)
 
Buying guns to make a profit could be consdered "engaging in the business" of buying and selling guns. That requires an FFL.

If you buy for your collection, and put all money into your collection, that should be okay. Similarily, I understand that if you keep a gun for your use for more than a year, then sell it, it is not considered "engaging in the business".
