SB 234 – On Senate Special Calendar for April 27, 2011

Members and friends,

We’re down to the wire. On Wednesday, the Senate will vote on SB 234. This bill includes open carry, vehicle carry, DOACS fingerprint authorization, and long gun/shotgun contiguous state purchase authorization.

Of course, the most contentious element is open carry. This is going to be a squeaker, folks. By now, the Senators should have already made up their minds. Nonetheless, Florida Carry is requesting one last push to deliver this baby.

We’ve shown the untruthful (and perhaps unlawful) tactics used by the various Sheriff’s offices and the Florida Sheriff’s Association that has spurred an official investigation by the State Attorney’s Office, FDLE, and OCSO internal affairs. Pinellas County Sheriff Coats told the committees his speculation on open carry, then admitted that he hadn’t researched how open carry works in any other state. The deputies of the Hillsborough County Sherriff’s Office pulled over and detained a licensed concealed carrier just a few days ago for “printing” of his lawfully carried firearm despite their Sheriff’s testimony to the legislature that his officers would never do such a thing. The fact is that, not a single opposition speaker has ever addressed how so many other states could have open carry without the doom and gloom consequences that they espouse. Is it coincidence that the same predictions were made in 1987, by the same organizations, with regards to shall-issue concealed carry?

Dear Senator,

Senate Bill 234 deserves your support, as do the 801,219 active concealed carry licensees who have patiently waited for this bill for over 23 years. Governor Scott has already stated he will sign the bill as a 2nd Amendment supporter and open carry advocate. Florida is one of only seven states that do not permit some form of general open carry. The objections raised by law enforcement and retail associations make no mention that the practice of open carry is successful in 43 states, nor do they acknowledge their dire predictions are the same “blood in the streets” arguments of almost a quarter-century ago. Those predictions have been proven unfounded.


Please help support the law abiding carriers of Florida and vote in favor of SB 234.

Well, thats it. They just amended it. Game over.

The bill will be voted on as inadvertent exposure. We lose.
 
It’s not what we wanted, but it is progress.

Look how long it took the antis to put us where we were in 1987. Look at the progress we’ve made since then.

I don’t understand all the gnashing of teeth and cries of despair. We’re gaining ground, not losing. They’re the ones who are losing.

The antis wanted total gun control (that’s a total gun ban) and were getting it a bit at a time. We stopped them.

We want zero gun control for law-abiding and sane citizens and we’re getting it a bit at a time. They can't stop us, but they can make it hard. Deal with it.

Have some patience, will you?
 
Contact the house members and urge them to pass HB 517 unamended.

Possible, just possible this may work. If not and the amended bill hits Scott's desk write him and urge him to veto it so that we can start over cause if this passes, your not gonna see the issue picked up again.

This is NOT progress its Bogdonoff being a RINO and caving to law enforcement and retail merchants.

Just how in the heck is this gaining ground? The issue was for open carry plain and simple. At this point there is no OPEN CARRY with the senate bill.

Care to explain just how an open carry bill that is no longer open carry is progress?:eek:
 
I was just told that if the senate bill and the house bill both pass their floor votes, but the senate bill is NOW vastly different the the house bill. Both bills if passed and different will go to a Conference committee, who will iron out the differences and make them equal again. After the conf. committee, the ironed out bill will go back to both the senate and house floors for votes... again. Basically both bills have to be passed and have to say the same thing before it will hit the governors desk for signing.

So we still have hope... it's not dead yet!

Who told you this was an open carry bill? That’s not how it was presented to the legislature. They were told it to keep licensed CCW holders from being arrested if their gun was accidentally exposed.

A real open carry bill, the kind we ought to have nationwide, would do what the 2nd Amendment intended, that is, allow all sane, law-abiding citizens to openly carry any weapon they own. This bill (and we don’t know what the bill will look like when it comes up for a final vote) isn’t going to be close to that.

At best, this bill will be a baby step. At worst, we’ll be where we were last week. Either way, we try again and keep trying until we get what we want.

This is going to be a long war. Our enemies aren’t going to quit. They didn’t quit when they lost a skirmish and they eventually came close to destroying gun rights in plenty of states and cities. We have to be just as determined.
 
No one told me, I read the original bill text.

Your opinion is that open carry should require no CCW permit, so in reality its not open carry, thats not my argument.

Open carry is just that open carry, permit or no permit. The permit debate is another issue all together.

This bill requires a permit. It's not another issue, it's part of the bill. It's not the open-carry-for-all bill we'd all like to see.

Several months ago, I was talking to one of Thad Altman’s legislative assistants. I didn’t get a definite timeline, but I got the idea that the plan runs something like this:

Step 1. Pass open carry of handguns for CCW holders.
Step 2. When the sky doesn’t fall, pass open of handguns carry for all law-abiding citizens.
Step 3. When the sky doesn’t fall, pass open carry of long guns for all law-abiding citizens.

They're working on step one. You (and the rest of us) want step 3 right now. It's unrealistic to expect that.

I’d expect the entire process to take 5-10 years, even with a Republican-controlled legislature. A SCOTUS decision might speed things up.
 
One of the things I saw and heard was that Dorworth spent a lot of committee time showcasing how inadvertent brandishing can get law abiding people in real trouble, and less time on the fundamental principle of open carry. The sheriff's spent most of their time showcasing what they felt were the looming catastrophes if this was to pass, and the NRA spent a lot of time trying to prove the sheriff's wrong. Right out of the gate it it was almost represented that a revision of the existing law to offer protections to licensed carry holders for inadvertent brandishing was what the original sponsor was really wanting...and here we are...just my thoughts...
