Cellphone Tracking Powers on Request

"Federal officials are routinely asking courts to order cellphone companies to furnish real-time tracking data so they can pinpoint the whereabouts of drug traffickers, fugitives and other criminal suspects, according to judges and industry lawyers," reports The Washington Post. "In some cases, judges have granted the requests without requiring the government to demonstrate that there is probable cause to believe that a crime is taking place or that the inquiry will yield evidence of a crime. Privacy advocates fear such a practice may expose average Americans to a new level of government scrutiny of their daily lives. Such requests run counter to the Justice Department's internal recommendation that federal prosecutors seek warrants based on probable cause to obtain precise location data in private areas. The requests and orders are sealed at the government's request, so it is difficult to know how often the orders are issued or denied."

In "Understanding Privacy -- and the Real Threats to It," Jim Harper, Cato's director of Information Policy Studies, writes:

"Whether it is anti-privacy regulation, data collection required by all manner of government programs, or outright surveillance, the relationship of governments to privacy is typically antagonistic. Privacy thrives when aware and empowered citizens are able to exercise control of information about themselves. Thoughtful policymakers should recognize the detrimental effects many programs have on consumers' privacy and respond with proposals that reduce the role of government in individuals' lives."

Re the following, excerpted from above, "In some cases, judges have granted the requests without requiring the government to demonstrate that there is probable cause to believe that a crime is taking place or that the inquiry will yield evidence of a crime."

Seems that these judges should themselves be judged and suitably punished, as it it appears that they have forgotten their own oaths of office, and the jobs they were hired to perform.

I thought it was all about terrorism?
 
This has been an on and off subject for years. I no longer have the source, but I remember reading that a cell phone could be remotely activated and monitored even though it was turned off. The only way to avoid it was to remove the battery.
