FTF deal w/FFL in NJ?

I know FTF sales of handguns is illegal in NJ. The buyer of my SP101 says he is a "pink card employee" of an NJ FFL holder.

Is there a legal way to do a FTF transaction with him or am I to ship it to his shop as usual?
 
If both you and he live in NJ and he has a firearms ID card and a valid permit to purchase a hand gun, you can do a face to face.
 
AFAIK, FTF on handguns is illegal regardless. Where can I verify what you said?
 
well, I wouldn't look to this forum to verify. Why not crack open the NJ Code and see what it says. Or ask the state police. Or the gun shop.

And if he's an employee of the gun shop - then why not just do it at the gun shop he works at??

A Permit to Purchase a Handgun must be completed on each handgun transferred in this state. It is the responsibility of the seller of the handgun to ascertain that the buyer has a valid Permit to Purchase a Handgun and one additional form of identification. The permit must be completed by the seller and buyer. It is the responsibility of the seller to forward the copies to the appropriate authority. Instructions are printed on the permit.
 
New Jersey Statutes:
2C:58-3. Purchase of firearms.
a. Permit to purchase a handgun. No person
shall sell, give, transfer, assign or otherwise
dispose of, nor receive, purchase, or otherwise
acquire a handgun unless the purchaser, assignee,
donee, receiver or holder is licensed as a
dealer under this chapter or has first secured a
permit to purchase a handgun as provided by
this section.

b. Firearms purchaser identification card.
No person shall sell, give, transfer, assign or
otherwise dispose of nor receive, purchase or
otherwise acquire an antique cannon or a rifle or
shotgun, other than an antique rifle or shotgun,
unless the purchaser, assignee, donee, receiver
or holder is licensed as a dealer under this chapter
or possesses a valid firearms purchaser
identification card
, and first exhibits said card to
the seller, donor, transferor or assignor, and unless
the purchaser, assignee, donee, receiver or
holder signs a written certification, on a form
prescribed by the superintendent, which shall indicate
that he presently complies with the requirements
of subsection c. of this section and
shall contain his name, address and firearms
purchaser identification card number or dealer's
registration number. The said certification shall
be retained by the seller, as provided in section
2C:58-2a., or, in the case of a person who is not
a dealer
, it may be filed with the chief of police of
the municipality in which he resides or with the
superintendent.



FTF sales are allowed in NJ, but the hoops to jump through would make it not worth it to me. If the buyer works at a dealer, I too would just use the dealer to transfer it. If a FTF sale, it appears as if you have to complete the Certificate of Eligibility form and file it with the local LEO agency:

:banghead: Face to face handgun transfers are 100% LEGAL in NJ, as long as the gun is legal, and the buyer has a current and active permit, there is no problem. The pistol permit has all the info needed of where to send each copy. I usually ask for a photocopy of drivers liscense and FID card when I do a face to face and supply the same to the buyer. I keep it in the file for all my purchases and sales.

We are talking NJ State Law here. ATF has no jurisdiction in state law. If you feel more comfortable shipping it to his FFL than do so.
