Is there anything wrong with my selling an individual a pistol FTF when they are in the same state, but a different city? They would drive from Tuscaloosa to meet me here in Montgomery. What should I do to protect myself? I just do not get that warm fuzzy feeling about it after talking with the buyer. I have sold guns to individuals in the past and as far as I know there is nothing wrong with it. All I am for sure is they have to be buying it for themselves. Thanks, AC

Thanks. I have asked (PM) if the gun is for him and if there was any legal reason he could not own one. I guess the fact that he was so anxious made me nervous.

Walkalong, when I sell a gun (especially a handgun), I require that the buyer have an Alabama concealed carry permit. I don't know of anything else to do to assure yourself of a good sale. You can make sure his (or her) name, DL#, and CCW# are on the bill of sale.;)

Good Luck!

Legal. You really don't need receipts or anything either. That is simply if you feel a paper trail is necessary. I think as long as you don't knowingly sell to someone who can't own one, no problem.

I have only sold a couple guns at shows and bought a couple FTF, but I have never seen anyone at gun shows or elsewhere bother with bills of sale.

He is more than willing to show his CCW and assured me the pistol is for him. I am much more comfortable now. I agree about bills of sale at shows etc. Most folks never do anything except exchange money and gun. He is a brand new forum member with 0 posts and was anxious to do this so I just was a little uncomfortable at first. Thanks.

I wouldn't mind a bill of sale myself, but I guess I might have an issue with someone wanting too much information. It is not necessary IMO. If I want all that paperwork, I can go buy from a dealer.

Viewing the licenses is no problem. I showed the guy my CHL last time I bought a rifle FTF. Signing a little statement that I am legally able to own a gun or signing a Bill of Sale with serial #'s is easy too. That ought to be enough to prove later that you sold the gun. That is all you are really after. Demanding DL#, CHL#, home address, proof of insurance, mother's maiden name, next-of-kin and everything else be on the bill of sale is excessive, IMO. :D

The way I usually handle it is simple. I ask if the buyer (or seller, depending on which end of the sale I am on) is a resident of this state, and if he is legally allowed to own a firearm. If the answer to these two questions is "yes", then the money and guns are exchanged.

I don't ask for a driver license, pistol permit, ID, or a receipt; nor will any be provided if asked. If the other person does not like those terms, then no sale.

I am not handing over private information to a person I don't know, but who now knows I have guns at my house.

This process is completely legal in my state. You are not required to see ID, and I really don't think seeing ID should make you feel any more comfortable that the person is who they say they are, since fake IDs are so common.
