VA used to honor Arizona permits, but last year that recognition was
rescinded. This year there were some changes to Virginia
reciprocity/recognition laws that went into effect on July 1 and VA
once again honors AZ permits!

IMPORTANT NOTE: Arizona does NOT honor Virginia permits! This is a
one way deal, with VA taking the high road. It is a good investment,
as someday (I don't know when) AZ will probably honor VA. For the
time being, AZ honors UT and FL permits, which you can get as
non-residents.

I have an e-mail into DPS.

However, http://www.dps.state.az.us/ccw/recip.asp will show that Arizona recognizes *far* more states than recognize Arizona.

We pushed for a law that would do just that, hoping that widened "unilateral" recognition would lead to more recognition for us. It has, but if there is no training requirement (Indiana or Georgia), AZDPS won't go for it.

What's the law change in Virginia?

Here is AZ DPS's response to my query.

Too many deficiencies for them to accept it...

Mr. D,
You are correct, Arizona does not recognize Virginia. The reasons for lack
of recognition are due to substantially different regulations in regards to
the Concealed Weapon Program. The following statements are quoted from the
Virginia Code 18.2-308. "Personal protection; carrying concealed weapons;
when lawful to carry."

1.) In Virginia Code 18.2-308.D. it is stated "The court shall consult with
either the sheriff or police department of the county or city and receive a
report from the Central Criminal Records Exchange. As a condition for
issuance of a concealed handgun permit, the applicant shall submit to
fingerprinting if required by local ordinance in the county or city where
the applicant resides.......".

In Arizona, fingerprinting is required.

2.) In Virginia Code 18.2-308.D., it is further stated "If the court has
not issued the permit or determined that the applicant is disqualified
within 45 days of the date of receipt noted on the application, the clerk
shall certify on the application that the 45-day period has expired, and
send a copy of the certified application to the applicant. The certified
application shall serve as a defacto permit, which shall expire 90 days
after issuance, and shall be recognized as a valid concealed handgun permit
when presented with a valid government issued photo identification pursuant
to subsection H, until the court issues a five-year permit or finds the
applicant to be disqualified. If the applicant is found to be disqualified
after the defacto permit is issued, the applicant shall surrender the
defacto permit to the court and the disqualification shall be deemed a
denial of the permit and a revocation of the defacto permit."

In Arizona, a permit will not be issued until the application has been
processed(including a criminal background check).

3.) In Virginia Code 18.2-308.J2., it is stated " An individual who has a
felony charge pending or a charge pending for an offense listed in
subdivision E 14 or E 15, holding a permit for a concealed handgun, may
have the permit suspended by the court before which such charge is pending
or by the court that issued the permit."

In Arizona, a Concealed Weapon Permit holder who has a felony charge
pending will be suspended pending the outcome of the offense.

4.) In Virginia Code 18.2-308.P1., it is stated " Nonresidents of the
Commonwealth 21 years of age or older may apply in writing to the Virginia
Department of State Police for a five-year permit to carry a concealed
handgun.....etc. The applicant shall be made under oath before a notary or
other person qualified to take oaths on a form provided by the Department
of State Police, requiring only that information necessary to determine
eligibility for the permit. If the permittee is later found by the
Department of State Police to be disqualified, the permit shall be revoked
and the person shall return the permit after being so notified by the
Department of State Police."

In Arizona, we do not issue permits to nonresidents until their application
has been processed to include a complete criminal background check.

I hope this helps you understand the differences between Arizona and
Viriginia, and comprehend why we do not recognize Virginia permits. If
Virginia changes these codes in the future, please notify us so we may
consider them for recognition.

Thanks for taking that step... I haven't received a reply yet re your question of VA law change, but some language (if not all maybe) resembles newer (7/1/04) changes.

I will send your last post (the reply you received) on to others for whatever the value.

At least we now know the AZ/VA criteria difeerences.
