are the transactions done through websites such as gunbroker, gunsamerica, and auctionarms considered "private sales" in that you are not buying from an FFL? i ask because i'm 19 (almost 20) and will be living in vermont in the next few months. i would like to get a handgun for self defense (as i mentioned in some earlier threads) but wouldn't be able to do so from an FFL as i am not 21. could i buy a gun through one of these auction sites, have it sent to an FFL in vermont, and not be breaking any laws?

In a way they are, however, any firearm purchased that way must be sent to an FFL dealer. When you go to pick it up they will then perform a NICS check and have you fill out the paperwork. Basicly it's the same as going to your local firearms dealer and picking one up there. It may be different if you live in the same state as the seller, they are not a dealer, and you pick it up yourself.
 
First rule, if it goes through an FFL you have to meet all the purchase requirements as if you bought it from an FFL. So for handguns, first is 21 years old.

The auction website is merely an advertising service. You are buying the gun from the person who posted it on the website (and FFL's post on there too, BTW). So if you buy from someone from the auction website who resides in your own state, it is considered a Face to Face transfer and those laws apply. Yes, you can buy a handgun, in that case, at less than 21 (which I think Vermont allows). The trick is getting that handgun physically shipped to you. You might get UPS to do it, it is in their written policies that they will, but their verbal policy is that they only ship to FFL's/Manufacturers.

If you purchase a handgun from a person advertising from out of your state, than it must be sent to an FFL in your state. In order to retrieve the handgun from the FFL in your state, you must meet all the purchase requirements as if you actually bought it from the FFL (which you did not do, but the FFL is doing the transfer). So, until you are 21, you cannot buy from an individual outside your state.

yes, i completely understand. the point about finding someone through gunbroker who's in the same state is an interesting one. thanks for both your posts.
 
If you are legally a resident of VT, you could either buy one face to face (lots of guns can be found at yard sales and such in VT) or buy one and have it delivered to you if the seller lives in VT also, so it never crosses state lines. Keep in mind many sellers on those sites are in fact FFL holders, who just happen to use those sites to sell. And many will not ship to a non-FFL even if it's within the same state, despite the fact that it's legal. VT's minimum age to own a firearm without parental consent is 16. Federal law basically says you must be 18 to possess/own a handgun. You can't get ammo for a handgun either from a dealer until you're 21, so that'll be another hassle (though many handgun rounds are used in rifles, and dealers may at their discretion sell it to you if they believe it's for a long gun)

If you are planning on leaving VT after a few months or so, and returning to another state as a home, you can't legally buy a handgun in VT, only a long gun (this is federal law) since you can only buy a handgun in your state of residence. You could legally buy an "antique" (something made before 1899, or a modern non-cartridge firearm, such as a cap and ball revolver) right through the mail, no FFL involved. Keep in mind some sellers of these guns still will ask for proof of age, possibly of being 21. If your location and state of residence, as it says under your username, is New Jersey, you'll have to buy a handgun in NJ, and NJ has very strict laws, as you may already know, quite different from VT so if that is your state of residence, things are complicated.
 
i am moving to vermont for school, so i'll be considered a resident. and yeah, new jersey gun laws are crazy.
