Gun Show private sales?

Hey guys! Well I am wanting to sell a nice SKS I have at a gun show here in Kansas.

However, I am living here because I'm in the military. I got my Kansas CCW lisence, but I am not sure if I am considered a permanent resident or whatever. I am originally from Illinois, born and raised.

I am asking if for one, is it legal for me to go to the gunshow in Kansas and sell my SKS to private individuals? If so, how do I do that legally? I have only ever sold guns to FFL dealers, not people at guns shows who might want to buy it.

So please help me! I really want to offload this gun this Saturday if at all possible!
 
Flowchart:

IF

You can legally walk into a FFL there and buy a firearm = true? (yes you can if you are posted there)

THEN

You are legally a resident under federal law. (And you are if you are posted there)

THEN

Go forth and sell.

ELSE (not for you unless you are simply TDY) = NOT RESIDENT.


You're good to go.


Method? Drop a pencil down the muzzle with an index card taped to it marked "for sale" like a flag, sling it, and walk the show. Enjoy.

Great to know guys! I have to bring a copy of my military orders in when I buy a gun here though. Does that change anything? Do I have to present my orders to the person I'm selling the gun to?

Also I've never done a transaction like this... I'm kind of scared and don't know what to do. Do I just walk around the gun show with the gun on my back, with a for sale sign on it? When someone asks and the price is right, do I just take the cash and give him the gun? Do I have to fill out any paperwork?

Yes you can just walk around and sell it for cash, I personally wouldn't sell it to someone visually sketchy, but as long as you don't knowingly sell it to a prohibited person you're good.

Only if the OP is a resident of Kansas for the purposes of federal interstate gun transfer law. And he is a resident of Kansas for the purposes of federal law only if his permanent duty station is in Kansas. See 27 CFR 478.11 (emphasis added):
State of residence. The State in which an individual resides. An individual resides in a State if he or she is present in a State with the intention of making a home in that State. If an individual is on active duty as a member of the Armed Forces, the individual's State of residence is the State in which his or her permanent duty station is located, as stated in 18 U.S.C. 921(b)....

We can't know that for sure, but the OP should know.
 
There are no legal hoops to jump through when selling a long arm FTF in Kansas.

If it were a handgun, you would need the purchaser to provide proof of residence in Kansas.
If he is a Kansas resident, you can proceed with the FTF sale.

Otherwise, if he lives in another state, the transfer would have to be done by an FFL and the handgun sent to an FFL in his state for delivery too him.

Under Federal law, he couldn't just pay you and walk out with it.

Even in the case of a long gun, if the buyer is not a Kansas resident under federal law the sale will need to go through an FFL. However, in the case of a long gun, it could probably be an FFL in Kansas unless the buyer is a resident of certain States (e. g., California).
 
Oh I see I see! Well thanks guys, I now feel so much better about this. I can't wait to unload this gun and use the cash to... BUY ANOTHER GUN!!!!! :what:!!! :D!!!
