The University of Colorado currently forbids holders of conceal-carry permits to be armed on campus. A current bill under review in the Colorado Legislature would allow permit holders to carry on campus. As the graduate students at CU-Boulder, they took interest in a resolution proposed by the United Government of Graduate Students (UGGS) that would oppose allowing conceal carry on campus. What follows is adapted from the response to the resolution, which was sent to the UGGS representatives a week before their February 19 meeting to vote on the resolution.

The most interesting aspect of this controversy is that Colorado state law does NOT prohibit carrying a weapon on campus with a valid permit. CU and other institutions of higher learning are relying on policy set by the Regents of the university and a Formal Opinion, No. 03-03, by then Colorado Attorney General Ken Salazar that university policy trumps state law. While I do respect Ken Salazar, there is enough grey area in the cited case laws to think that another attorney or a court could come to a different conclusion.

Colorado law explicitly names CCW on college/university campuses as legal with a valid CCW. The issue is whether the CU Regents have the authority to make laws that trump the statewide CCW pre-emption law.

With this statement in mind;

What charges can/may be leveled against somebody that does carry on campus?

Does the University have the clout to charge some kind of legal charge against a person that carries a weapon or just tell them to leave the campus and if they don't leave, get them on a traspass charge.

basically if the person caught carrying on campus is faculty or a student, they'll be fired/expelled. I don't know about any legal action that can be taken. (This is in VA, but it sounds similar in CO)

Desertdog it's cool to see someone from Ridgecrest...I had a relative who lived there for many many years before she passed away a few years ago sadly...
Visited Ridgecrest twice...nice place :)
