This was the argument against some of the restrictions introduced by DC when they lost the original Heller case in the Supreme Court. So this is currently a loss for the gun rights side.

As I understand it, the case has been dismissed with prejudice, so it cannot be represented in another form at the same level, but can (and probably will ) be appealed to the DC circuit court.
The original Heller case was also lost at the District Court level, then appealed to and won at the Circuit Court level. DC appealed to the Supreme Court & lost.
Fingers crossed, that will be the future outcome for this case.
