I have a legal type question. Can I SHIP hicap mags to a friend in Mass.??

It's illegal for a Mass. resident to possess any post-ban (Sept 13, 1994) hi caps. So while it might be legal for you to ship them, it would be illegal for your friend to receive them.

What about PRE-ban?

Currently made hi-caps don't have a date on them, so it would be nearly impossible for someone to determine when, exactly, they were made.

I wouldn't ship any TO him, but when he comes to visit you, he might want to take back all of his hi-cap mags he let you borrow.

If, on the other hand, he can't possess ANY hi-cap mag, regardless of manufacture date, then he should move out of that state or quit bitching about the asinine laws.
 
Yeah, don't ship to him.
If you do, make darned sure you don't use USPS. I think that's considered using the postal service to do illegal things (that's a legal term).
I'm pretty sure that's why Tommy Chong went to prison a couple of years ago. He was making "smoking devices" in a place where they were legal and shipping to places where they were not. At least that's how he told it.

Your friend will have to come see you in a free state if you want to stay safe.

Looks like they are OK, but how are you going to document it? Also, the Mass law says they must be "lawfully possessed" prior to the ban date, not just manufactured before then. The difficulty is that most mags are not marked in any way to prove build date one way or the other. Obviously it won't fly for a model of firearm that wasn't available at that time. As much as I might want the mags, I think I would err on the side of caution (and work with my state association to try to change the damn law). As they say, you might beat the rap, but you'll still take the ride.

I don't live in MA and never, ever would choose to do so. Consequently, I don't feel like looking up their stupid laws regarding such things.

But, as I said in my first post, he needs to come to where HIS hicap mags currently are, give thanks to the person for taking good care of them, then taking them back to MA (presuming they are not illegal to possess in the first place.)

Obviously, if it's an XD-m, then he's S.O.L., but there are many other guns that have been around prior to 1994
 
He's in Mass and should abide by the laws where he chooses to live. We can't suggest ways to skirt the law and still claim to be taking "The High Road".

Maybe suggest he move? Otherwise, it's best he come up with his own ideas. JMHO

Here's a better question: Why should it be incumbent upon YOU to fix up your MA living buddy with hicap mags?
 
Or, better yet,

Why are you considering something that will place your liberty, freedom, and family in harm of legal prosecution (even if you don't agree) for your buddy.

Think of it this way, what would you tell your mom or wife, if the FBI comes for you on behalf of the Mass. state police, or PO Inspectors? If he wants them, he can order them off Flee bay like everybody else, or stick to the legal instate trade...


He can always move and join the rest of us in the free states
