If I am reading things right, it is illegal for a civilian to possess a box magazine that feeds more than 10-rounds irregardless of whether it is for a rifle, carbine, or handgun.

Is this correct?
 
You CAN have one,
as long as it was MANUFACTURED before 1994.
You know how much they cost up there?!?!?!?

Call a local gun store and ask for pre-ban mags,
they will be glad to charge you through the roof.
 
Actually I am in Texas and got a phone call from my sister-in-law who lives in New York state and is having problems with an X-boyfriend who won't leave her alone and is being stalked. She was asking about handgun recommendations and I wanted to be sure I did not steer her toward something she could not buy up there.

Does that include handgun AND rifle?

Is is cheaper to buy a pre-ban mag from someone out of state?

In NY, you need a permit to even OWN a handgun. Even just having one in your home. You can't even buy a handgun without a license. If your sister doesn't have a license already, she is going to be 6 months waiting. She can buy a shotgun at Walmart tonight though. . .
 
Have her file a restraining order

If you have a restraining order, the cops have to expidite your application for a handgun.
 
I'll make sure and discuss the restraining order option with her.

Are you serious? You mean to say that every legal, civilian-owned 10+round box mag in NYS was here in 1994 and never left? I can't import a pre-ban box mag? How do they enforce that? If I get one into the state, assuming that they are all marked with date codes, but it IS pre-1994, how could I get in trouble? They aren't registed, nor do they have their own individual serial numbers. . . right?

If it's pre-ban, then I think it's ok. If you go out to PA, but a (NEW) 32 round Glock mag, and bring it back to NYS, I'm rather sure you will be in deep poop if you get caught.
 
just because i'm really curious, does this 'law' apply to mags ONLY bought in new york? How does NY state law prevent you from buying magazines via mail order?
 
You CAN buy a mag from another state so long as it is pre ban. The problem is knowing if the mag was made pre ban or an unmarked after "sunset" (end of the ban) mag. I looked into this because I want to buy a few BHP 13rd 9mm mags.:banghead:

It is a class D felony to manufacture, transport, dispose of, or possess a large capacity ammunition feeding device, which N.Y. Penal Law § 265.00(23) defines as "a magazine, belt, drum, feed strip, or similar device, manufactured after September thirteenth, nineteen hundred ninety-four, that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition." Section 265.02.
 
Oh Lord, here come the speculators... I almost had to move to upstate NY, but I wanted to get an AK. Well here's the rules if you live in upstate NY:

Pretend the Federal Assault Weapons Ban never expired.

There's the rules. You can get hi-cap mags, they just have to be Pre-Ban. You can purchase them out of state as well, but the problem is, many dealers are wary of selling them to you, because they don't know NY laws.
 
I'm not a HUGE gun expert, but how would anyone know that a magazine is pre-ban? are magazines serial numbered as well?
 
Some post ban mags are different than pre ban

Glock mags for example. Its easy to tell whether its pre or post ban.
NY gun laws suck. Don't come here.

Here in NY we have the same AWB that was national from 1994-2004, except ours never expired.

Hi-cap magazines ARE allowed, as long as the were produced before 1994. They can be imported into the state as long as they were produced before 1994. Many "banned" guns are also legal, as long as they were produced before 1994 (My buddy has a Thompson, folding stock AK, MAC-11, and more, all purchased before the ban)

Getting a handgun permit, even with a RO, could be more problematic. Depending on where you live (but almost everywhere) they are trying real hard to try and NOT give out handgun permits.

if you want to buy highcaps relativly cheap in NYS, watchout for the Syracuse gunshow this winter/spring.ar-15 20rounders NIW were $10 a piece last year.
