How could a presidential executive order effect our 2nd amendment rights? I'm assuming it cannot violate the 2nd amendment in any way. With that said, could an executive order be issued to ban the sale of any semi automatic rifles/shotguns/handguns that accepts detachable magazines? Are magazines that accept more than 10 rounds protected by the 2nd amendment?

They're also calling for stronger background checks on gun buyers and to prosecute those who lie on form 4473. Is the current NICS system not working? What's broke? What needs to be fixed? When you give them your driver's license or F.O.I.D. card info how can you get away with lying about anything, all current information about you is right there in their database.
 
Exec branch controls dept of justice. Anything in that world seems fair game. Number of ffls. Oversight of ffls. Overall budget, etc.
 
If Obuma issues an executive order for whatever he wants, it takes a 2/3 vote of both houses of congress to overturn it. There is no way 2/3 of the senate would vote against him.

And there are no gaurantees on the Supreme Court. Remember they upheld McCain-Feingold which everyone said was unconstitutional and that the SC would overturn it.
