How far off the ground do you need to be in your area?

I've never heard of this before now. I can see where it would be safer in areas that were more heavily populated because theoretically all shots are going into the ground. I don't think I would like being forced into a tree to hunt, but would prefer it to being told I had to use a shotgun. Seems like a better alternative to me.
 
Where I am at in VA (Cumberland Co) we have to be 12 ft off the ground to use a rifle. The obvious reason is the round goes into the ground after a miss or a through and through. I don't shoot unless I know my backstop anyway, but that is the train of thought.
