He won’t speed much time in prison . It will probably take 10 months to get it to trial and then a month long trial . His dad will be voted out of office and be leaving in January 2025 and then pardon Hunter . He might spend 4 months behind bars .
 
There's a silver lining to this, from the point of view of the pro-gun side. In August, a three-judge panel of the 5th Circuit, in the Daniels case, held unanimously that the drug-possession disqualification of the GCA '68, was unconstitutional (citing the Bruen case). The case has not been appealed, but for now, it has precedential value in the area of jurisdiction of the 5th Circuit.

The Hunter Biden case is more or less based on similar facts. If the courts reach the same conclusion (and in a high-profile case like this, there's a good chance it will get to the Supreme Court), then the unconstitutionality will be expanded nationwide. And probably not just regarding drug possession.

That's an unintended consequence of this prosecution. The probable result would run directly contrary to the Biden administration's gun policy.
 
Some interesting things to consider:
-The US Attorney's office in Dallas won't accept charges on 4473 violations. (and hasn't for at least a decade).

All gun laws are violations of the Second Amendment says the gun community.

Wow, that’s awful. I’m sure every gun owner in California, Colorado, Michigan and Washington has gotten rid of their firearms so they can smoke pot without breaking the law.

Interestingly, while I've known a growing number of professional working folks who acknowledge they enjoy the ability to buy and use legal recreational pot, none of them are gun owners. CA conservatively has at least 8 million legal gun owners (more than many entire state populations), but I'd have to wonder how many of them are actually the sort of folks who enjoy recreational pot use.

It will be interesting to see how all this plays out. The end result could be good or bad.

Granted I have not had my Type 2 FFL in 20 years. But I never saw charges brought up for 4473 violations by themselves. It was usually an add on charge for someone already facing multiple other charges.
 
I doubt very much anything will happen to him. The President will just pardon him if it comes to it. Just like I doubt anything will happen to Trump.
 
Maybe this will get blown out of proportion so lawmakers can “do something” and make it illegal to use most prescription drugs while owning a gun. The antis will try to capitalize somehow.

ATF, per Joe Biden's Zero Tolerance policy, will definitely go after FFL's for a wrong date, a transposed digit, a customer failing to answer "Reside in city limits" or any other error, omission or typo on the 4473.

Seems like the Firearm Owners Protection Act of 1986, that reigned in ATF's abuses, wasn't really a law.
 
We all know that the Biden administration is on the warpath against current FFL holders. And FOPA isn't really worth the paper it was types on. My local FFL has started doing all 4473's online instead of having the customer fill out the form by hand.

I disagree. Remember the US Attorneys were going to let him off with a slap on the wrist and protection from ALL future prosecution till they got called on it by the judge.

I think this is more like he's getting thrown under the bus to protect "The Big Guy".
 
Hunter does not have the full protections of the political elite in this country but he has lots of cover. Bottom-line, if any American citizen did what any of the political elites have done that is criminal or unethical, they would be fully held accountable. And if it was a military member, then God help them. There are diffierent standards for different Americans depending on what group you belong. Whether it is hillary, don, joe or some other corrupt politician, they can do whatever they want and get a pass for things a military memebr would be drawn and quartered. Worst part is their supporters make excuses for their actions.

Where I live, probably every random third person is both a gun collector and a recreational marijuana (illegal) (current or former) user. Heck, everyone I grew up with.....
 
We would not be talking about this if it were anyone other than the president's son. And while that is a significant thing, it does not make this any more on topic for THR than anyone else who does stupid crap with guns... Coupled with the political nature that has already lead to the removal of some posts, let's call this one done. While I fully acknowledge the corruption and underlying issues surrounding him and his prosecution on a number of crimes, it is simply off topic for us.
