The 2004 Daley "Assault Weapons" ban has been assigned a hearing date before the
Illinois Senate Judiciary Committee.

Senate Bill 2561 will be debated before the committee on Tuesday, February 24,
2004 at 3:30 PM.

If SB2561 is passed, most, if not all semiautomatic rifles and shotguns will be
banned and you will have 90 days to surrender your guns to the police or be
subject to forced confiscation procedures.

HERE IS WHAT YOU NEED TO DO TO SAVE YOUR GUNS:

1. Call the following Senators and thank them nicely for their past support of
the right to keep and bear arms. Tell them that you are against SB2561 and that
you would like them to vote against it when it comes before the Judiciary
Committee

A banning and confiscation of all semi-auto long guns with mandatory turn in.

That this is even being considered makes me :barf:
 
Not in IL, but I read the text of the bill and it makes it sound like ALL will be outlawed (i.e. no "pre-ban"). IS this right?
 
Havent heard anything about anything organized just yet, I have heard that Blago is going to show his true colors this year and come out in support of more gun control laws. The I$RA, as much as I dislike them, is probably the only thing that stands between us and total confiscation in Illinoised. There website had said that the plan was in the works but nothing has been posted on there about any judicial hearings.

I think that Blago has pissed off enough downstate Democrats to not goet any support from them for anything but I could be wrong.
 
I'm think about going if the hearing is going to be open to the public. I have heard nothing from NRA or ISRA on this. In fact if it wasn't for THR I'd be blissfully ignorant. It hasn't made the news down here.

Blagojevich is really burning his bridges with the other Democrats down here. The release of the budget with the closing of the Vandalia prison is another nail in his coffin. This is from an article in today's St Louis Post Dispatch. It'll give you an idea of how he's looked at down here now:

Union workers at the prison who supported Blagojevich in the 2002 election were especially upset.

"That's the one thing he said over and over, 'We will not balance the budget on the backs of working people,' and here I'm losing my job," said Kevin Springman, a guard at the center for nine years.

Steven Sipes, a guard for eight years, said prison workers were shocked Wednesday morning.

"Being union, we're led to believe the Democrats are there for us, but it's really hard to take today," Sipes said. "The union backed a Democrat governor this time, and this is what happens."

State and federal government jobs are almost the only jobs that could be considered middle class throught much of Southern Illinois. The loss of the prison will raise the unemployment rate in Fayette County from 8.4% to 14% and those were some of the best jobs in the area. I don't know how he can show his true color on guns and have any hope of staying alive politically down here. Add gun control to the economic policies and his refusal to move to the governor's mansion (which is unconstitutional BTW) and he's likely to be toast in Southern Illinois. Maybe he thinks he can win without the South....But he's sure not going to be popular with downstate Democrats after all this.

Jeff, maybe we could meet at the Capitol. Just beware the day off mind games. Last time they changed the date once and the time and place over and over. They claimed the date changed because two of Da Mayor's people died and the hearings conflicted with the funerals in some way, but that didn't explain the three changes of time and place on the day of the hearing.

When the hearing finally convened, however, the room and the balcony outside (overlooking the rotunda) were full of angry gun owners. I think it did make a difference.

I hope we can manage the same this time. If anyone is calling Barack Obama, in particular, I remember him as being particularly fair-minded and open to persuasion although he's not on our side. It would be a good idea to be firm but exceedingly friendly with him and his staff.

Also remember, people, that your calls WILL make a difference! Call the opposition too! Last time there were Senators on the committee who were piping up that they were willing to reconsider supporting the bill because they hadn't known it would affect "collectors!" There were others who wanted to know if it would somehow keep "legitimate collectors" from owning "examples of machine guns and such." (Machine guns being both illegal in Illinois and entirely unaffected by this bill.)

On the other hand, I'm sure they won't make the same mistakes this time. A short list:

  • I'm sure they won't try to present ten bills at once this time. Last time that made Daley look pretty stupid when ten of ten crashed.
  • The "old" bill actually made it illegal to carry an "assault weapon" on duty with a police department or national guard unit. Active duty was only an affirmative defense in court--so a police officer using an AR-15 could be arrested and forced to go to trial. I'm sure that provision has been cleaned up.
  • There was some doubt as to whether the old bill banned shotguns (at least slug guns) since it banned .50 cals. This allowed the ISRA to bring in The Deer Hunters, who would not otherwise have given a plugged nickel. This time I'm sure they've made it explicit that they won't touch shotguns, and The Deer Hunters won't take the day off work.
  • Daley was so convinced he could pass anything last year that his chosen "sponsors" didn't even read the bills. Two of them actually told the committee they couldn't answer simple questions about what "their" bills banned. I don't know if that was as important as I thought it was, but I bet it's not repeated.



My little sister is a bank teller at the branch in the Capitol. Maybe we can all grab lunch. The hearing WILL be open to the public unless they specifically say it isn't. I too wonder where in the world ISRA is on this. Usually this kind of defense is their game.
 
Could someone please post the text of the bill? Is this a City of Chicago thing or a State of Illinois thing? (And if it's the State, how is Daley involved?)

Daley is the defacto governor of the state. He ran it during the Republican Ryan administration by controlling the federal prosecutor looking into the drivers license scandal. Here is the text of the bill:

1 AN ACT in relation to criminal law.

2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4 Section 5. The Criminal Code of 1961 is amended by adding
5 Section 24-1.7 as follows:

6 (720 ILCS 5/24-1.7 new)
7 Sec. 24-1.7. Manufacture, possession, and delivery of
8 semiautomatic assault weapons, large capacity ammunition
9 feeding devices, and assault weapon attachments.
10 (a) The General Assembly finds that the high rate of fire
11 and capacity for firepower of semiautomatic assault weapons,
12 assault weapon attachments, and large capacity ammunition
13 feeding devices pose a significant threat to the health,
14 safety, and welfare of the citizens of this State, that the use
15 of these weapons, devices, or attachments for sport or
16 recreation is substantially outweighed by the danger these
17 weapons or devices present to human life, and that restrictions
18 should therefore be placed on the manufacture, delivery, and
19 possession of these weapons, devices, and attachments.
20 (b) Definitions. In this Section:
21 (1) "Semi-automatic assault weapon" means:
22 (A) any of the firearms or types, replicas, or
23 duplicates in any caliber of the firearms, known as:
24 (i) Norinco, Mitchell, and Poly Technologies
25 Avtomat Kalashnikovs (all models);
26 (ii) Action Arms Israeli Military Industries
27 UZI and Galil;
28 (iii) Beretta AR-70 (SC-70);
29 (iv) Colt AR-15;
30 (v) Fabrique Nationale FN/FAL, FN/LAR, and
31 FNC;
32 (vi) SWD M-10, M-11, M-11/9, and M-12;

1 (vii) Steyr AUG;
2 (viii) INTRATEC TEC-9, TEC-DC9 and TEC-22; and
3 (ix) any shotgun which contains its ammunition
4 in a revolving cylinder, such as (but not limited
5 to) the Street Sweeper and Striker 12;
6 (x) any firearm having a caliber of 50 or
7 greater;
8 (B) a semiautomatic rifle that has an ability to accept
9 a detachable magazine and has any of the following:
10 (i) a folding or telescoping stock;
11 (ii) a pistol grip that protrudes conspicuously
12 beneath the action of the weapon;
13 (iii) a bayonet mount;
14 (iv) a flash suppressor or barrel having a threaded
15 muzzle; or
16 (v) a grenade launcher;
17 (C) a semi-automatic pistol that has an ability to
18 accept a detachable magazine and has any of the following:
19 (i) an ammunition magazine that attaches to the
20 pistol outside of the pistol grip;
21 (ii) a barrel having a threaded muzzle;
22 (iii) a shroud that is attached to, or partially or
23 completely encircles the barrel, and that permits the
24 shooter to hold the firearm with the non-trigger hand
25 without being burned;
26 (iv) a manufactured weight of 50 ounces or more
27 when the pistol is unloaded; or
28 (v) a semiautomatic version of an automatic
29 firearm;
30 (D) a semiautomatic shotgun that has any of the
31 following:
32 (i) a folding or telescoping stock;
33 (ii) a pistol grip that protrudes conspicuously
34 beneath the action of the weapon;
35 (iii) a fixed magazine capacity in excess of 5
36 rounds; or

1 (iv) an ability to accept a detachable magazine.
2 "Semiautomatic assault weapon" does not include:
3 (A) any firearm that:
4 (i) is manually operated by bolt, pump, lever or
5 slide action;
6 (ii) is an "unserviceable firearm" or has been made
7 permanently inoperable; or
8 (iii) is an antique firearm;
9 (B) any semiautomatic rifle that cannot accept a
10 detachable magazine that holds more than 5 rounds of
11 ammunition; or
12 (C) any semiautomatic shotgun that cannot hold more
13 than 5 rounds of ammunition in a fixed or detachable
14 magazine.
15 (2)(A) "Large capacity ammunition feeding device" means:
16 (i) a magazine, belt, drum, feed strip, or similar
17 device that has a capacity of, or that can be readily
18 restored or converted to accept, more than 10 rounds of
19 ammunition; or
20 (ii) any combination of parts from which a device
21 described in subparagraph (i) can be assembled.
22 (B) "Large capacity ammunition feeding device" does
23 not include an attached tubular device designed to accept,
24 and capable of operating only with, .22 caliber rimfire
25 ammunition or any device that has been made permanently
26 inoperable.
27 (3) "Assault weapon attachment" means any device capable of
28 being attached to a firearm that is specifically designed for
29 making or converting a firearm into any of the firearms listed
30 in paragraph (1) of subsection (b) of this Section.
31 (4) "Antique firearm" means:
32 (A) any firearm, including any firearm with a
33 matchlock, flintlock, percussion cap, or similar type of
34 ignition system, manufactured in or before 1898;
35 (B) any replica of any firearm described in
36 subparagraph (A) if the replica:

1 (i) is not designed or redesigned for using rimfire
2 or conventional centerfire fixed ammunition; or
3 (ii) uses rimfire or conventional centerfire
4 ammunition that is no longer manufactured in the United
5 States and that is not readily available in the
6 ordinary channels of commercial trade; or
7 (C) any firearm (other than a machine gun), which,
8 although designed as a weapon, the Department of State
9 Police finds by reason of the date of its manufacture,
10 value, design, and other characteristics is primarily a
11 collector's item and is not likely to be used as a weapon.
12 (c) Except as provided in subsection (e), 90 days after the
13 effective date of this amendatory Act of the 93rd General
14 Assembly, it is unlawful for any person within this State, to
15 knowingly manufacture, deliver, or possess or cause to be
16 manufactured, delivered, or possessed, a semiautomatic assault
17 weapon, a large capacity ammunition feeding device, or an
18 assault weapon attachment.
19 (d) Any person who knowingly possesses a semiautomatic
20 assault weapon, large capacity ammunition feeding device, or
21 assault weapon attachment must, within 90 days after the
22 effective date of this amendatory Act of the 93rd General
23 Assembly, destroy the weapon or device, render it permanently
24 inoperable, relinquish it to a law enforcement agency, or
25 remove it from this State.
26 (e) A person has an affirmative defense to an alleged
27 violation of subsection (c) of this Section if he or she
28 lawfully possessed or delivered the semiautomatic assault
29 weapon, large capacity ammunition feeding device, or assault
30 weapon attachment while in the performance of his or her
31 official duties as a peace officer, correctional institution
32 employee or official, or member of the Armed Services or
33 Reserve Forces of the United States, or of the Illinois
34 National Guard.
35 (f) Sentence.
36 (1) A person who manufactures, possesses, or delivers a

1 semiautomatic assault weapon in violation of this Section
2 commits a Class 3 felony for a first violation and a Class
3 2 felony for a second or subsequent violation or for the
4 possession or delivery of 2 or more of these weapons at the
5 same time.
6 (2) A person who possesses or delivers in violation of
7 this Section a large capacity ammunition feeding device
8 capable of holding more than 17 rounds of ammunition
9 commits a Class 3 felony for a first violation and a Class
10 2 felony for a second or subsequent violation or for
11 possession or delivery of 2 or more of these devices at the
12 same time.
13 (3) A person who possesses or delivers in violation of
14 this Section a large capacity ammunition feeding device
15 capable of holding more than 10 rounds but not more than 17
16 rounds of ammunition commits a Class 4 felony for a first
17 violation and a Class 3 felony for a second or subsequent
18 violation or for possession or delivery of more than one of
19 these devices at the same time.
20 (4) A person who possesses or delivers in violation of
21 this Section an assault weapon attachment commits a Class 4
22 felony for a first violation and a Class 3 felony for a
23 second or subsequent violation.

I'll let you know over the weekend if I'm coming up. Been trying to generate some heat down here ever since I read this. The bill only has one co-sponsor. I still don't know where the ISRA is. I'm wondering if they are keeping this quiet because they know it's not getting out of comittee or to try to sneak it through.

Illinois is trying to end the rights of private citizens from owning semi-automatic rifles and shotguns under their "assault weapons ban." If it passes, Illinois residents will have to surrender their guns within 90 days or be forced by the police.
 
As an Illinois resident, don't be deluded by the fact that a bill is weak or only has one sponsor. There are many and devious ways that the Weasels of Springfield use to get stuff through the General Assembly. One tactic, if a certain type of bill has bombed, is to try to slide it in in an innocuous manner on a bill with other things that are legitimate or that people really want. Even though the Illinois Constitution of 1970 specificially prohibits bills on more than one subject, this rule is regularly violated.
As far as violating constitutions goes, everyone reading this thread presumably realizes that no constitution in this country has any more meaning, in the twilight of the Republic, than a given judge on a bench wants to give it. In our impatience with the legislative process, we search for definitive yes/no answers by allowing ourselves the bad habit of playing Judicial Las Vegas with our rights.

We have now set up men and women in black robes as despots, rather than as fair and final arbiters of the law. The radical pronouncements of the Ninth Federal Circuit panel of judges on the west coast should serve as an indictment of a system where every political question of any importance is now settled not in Congress or the state legislatures, but in lengthy and turgid legal decisions that constantly redefine the written laws and constitutions. We are thrown headlong into a period of Legislation by Judicial Fiat, and there will be a heavy reckoning before it's over.

Think about it: if the word "people" in the Bill of Rights can be reinterpreted by the courts -and it has, by some- to actually mean "government," then we are well and truly screwed, and if we sit stil for it, we deserve it.

Or so they think. The ISRA is sending out Emergency E-Mails that Senate Bill 2561 will be debated in the Illinois Senate Judiciary Commitee on Tuesday, Feb. 24 at 3:30 P.M. This bill would ban all semi-automatic rifles and shotguns and you would have 90 days to turn then in or FACE FORCED CONFISCATION. There are Senators to call that have SUPPORTED gunowners in the past on this last year. They can be called and thanked for their past vote and politely asked for the same stance.

Anyone can do this. In my case I may remind them that people are mre likely to move out of state and bring their law-abiding tax dollars to another State than suffer an injustice such as this. You may also remind them that there should be no new firearm legislation passed as they do not currently prosecute crime aggressively under the multitude of current gun laws and this has nothing to do with crime. It has everything to do with the UN plan for global gun control even if these particular Senators are unaware and a zombie-like part of the machine plot. Thanks! Good Luck And Good Hunting!

I still don't like it, but lets be factual, this is not a ban on all semi-autos, this is to prepare for the AWB sunset. It is the same bill they submitted last year.

How are they planning on enforcing this? No gun owner is going to turn in
his "banned" gun. People in the PRK didn't. I'm wondering if this did pass if
courts rule that if a firearm didn't have the same name as one on the list then
that firearm is legal? This did happend in New Jersey.

And how many people are going to do this? And I'm sure this law will
be full of loopholes. And considering how many gun owners have said
"you can take it from my cold dead fingers" how many LEOs are going
to be willing to do door to door searchs?

This sounds like a classic Illinois political shakedown. They propose a ridiculous law, just to get the lobbyists to come across with "incentives" to the legislators to oppose it.

I moved from Illinois nearly 20 years ago, and I don't miss it. There used to be some common sense there, but not any more.

This was referred to as the "2004 Daley Assault Weapons Ban". I didn't realize the mayor of Chicago ran the entire state. :scrutiny:
 
Hand picked governor

Daley has Blagoyevich as the governor.

1. The governor is the son in law of one of Daley's aldermen cronies, Richard Mell

2. The "governor" refused to move to the capital in Springfield and instead lives in Chicago

3. Our "governor" proposed total ban on ownership of .50 calibers with a rousing speech suggesting that "a person could shoot Sammy Sosa at Wrigley Field fromt eh top of the John Hancock building" (I am not making that up, honestly)

4. He also proposed raising the cost of the already onerous FOID (Firearm Owners ID Card Illinois shakedown) from $5 for 3 years to $500 per year to "offset the cost of gun violence".

5. The Republicans that might offset this keep shooting themselves in both feet with a governor so crooked and corrupted that his entire former staff is either serving time or waiting for trial. He has been indicted too. They keep running the same good ole boys that do not resonate with the people and are truly RINO.

6. The only hope for limiting this kind fo crapola is the downstate Demcorats in the legislature

It's ugly in here and until Daley chokes on a Polish at one of his expensive "Fests" we're stuck with it.
