IL. Gun laws and foid Joke?

heres one for ya i got denied my foid due to 430 ilcs 65/8 that says if you was under the age of 18 and was convicted of a crime that if you were over 18 could have been tried as a felony youre card will be revoked and denied for a period of 10 years after the 10 years you must file a motion with the county to have youre juvinile record vacated by god not expunged wont work ( 430 ilcs 65/10 ) now i tell you this is screwed up apperently im the only one in vermilion county who has this problem. after trying at the court house for 5 straight days i had to break down and spend my hard earned money to see a lawyer (which the ISP said this was simple to do) and the kicker the ISP and the FBI issues me a card so i can carry concealed while on the job. but i cant posses a firearm tell me is the foid act a joke or what???
 
1) The reason for that disqualifier is as a juvenile, even tho you may have committed a felony violation, you were processed differently because you were a juvenile. Turning 18 doesn't automatically wipe away a criminal record. It's still a felony crime.
2) What is this card "the ISP and the FBI issues me a card so i can carry concealed while on the job"?

i wasnt convicted of a felony i was convicted for attempted burglary which was a misdemeanor crime at the time of conviction. only in the later 90's did they revisit the law and made it a felony but only if entry was made. in my case no entry was made. and the card is a tan or fac that is issued to you if you are represented by a company that is licensed and bonded.

Come on. He was a juvenile. Teens and pre-teens actions are often based on emotions, not logic and consequence. This is why we have laws saying you must be 18 or 21 in order to do certain things.

Bottom line is, dbake's rights should've not been infringed upon as an adult.

Hope you learned your lesson then. You made a choice, even as a juvenile. Now you have to pay the consequences. Lesson # 1 in life.

Neither the ISP nor the FBI issued you that card nor did either have anything to do with issuing that card. The card is issued by the Dept of Financial and Professional Regulation which has nothing to do with either the FBI nor ISP.
 
Somehow having a former burglar as a security guard does not make me feel all that secure.
 
You can petition the court to expunge your criminal record. If you have gone 10 years with no further trouble with the law a non-violent offense will usually be erased and it never existed legally at that point. Ask an attorney or a local legal aid office.
 
I'm guessing your crime was the slaughter of all the punctuation keys on your keyboard?

and who tells the idpr that it is ok to issue a fac? The background checks of the isp and the fbi. From all the papers i signed it looked pretty clear who the real responsible people are. But dunno tho so at any rate the expungment method according to the isp wont work becouse it doesnt remove the record from file only hides it they can still see it but like before they cant have it. Its the same problem i go through every 3 years on perc 2 years on fac and 5 yrs on foid. it s the never ending battle i hate. sorry bout the punct. it was a quick post last time lol.

No one tells the IDFPR to issue anyone a tan card. The ISP doesn't and neither does the FBI. The IDFPR conducts their own background checks, they issue the cards. It's their job and responsibility. They have no affiliation with the ISP and the ISP has no affiliation with issuing the tan cards. The IDFPR is their own agency. Bottom line is " the ISP and the FBI issues me a card" is in no way factual info.
The ISP issues the FOID card. It is a completely different process and procedure. One card has nothing to do with the other. However, I am curious why IDFPR is issuing you a tan card when you have a criminal record and no FOID card. But they've made screw ups before. Maybe IDFPR will learn of their mistake and rectify it.
You've been told what you need to do to get your record straight. Hire an attorney and listen to what he tells you. You won't be able to do it without an attorney. He will know what needs to be done. This requires a legal filing which means it has to be properly written using correct English, punctuation, and grammar.
 
I'm confused as to how you could get a FAC without a FOID.:confused: I'm sorry but I have to call BS on this one because on the FAC itself, there is a clear space for the FOID # The application could never be completed without a copy of your FOID sent in by your employer for the FAC.

We just had a guy who went through the PERC and had a hit on his FBI. I told him to hire an attorney to take care of the matter and he got mad at me for that suggestion...:rolleyes:

The PERC is issued by the state, the FAC is also issued by the state, but owned by the employer. The FOID is issued by the ISP. Getting all that paperwork together is a real PITA.
