Illinois Bans Possession of Dogs by Convicted Felons

Will all the pet stores in Illanoise have to run background checks on people buying dogs?

When are they going to crack down on all those dog shows? (isn't that where convicted felons buy their dogs?)

Are Illanoyed cops going to have to start carrying scales to weigh dogs? (and will the crooked cops start carrying a "throw down" dog around in their cars?)

Are leashes and collars and chew toys going to be considered "dog paraphenalia"?

Will SWAT teams be doing no-knock raids based on a informant's tip that someone has dogs in their house?

What about a resident of another state who is just driving through Sillinois with a dog in his/her car?

Ok, my mistake on the 30 pound requirement. I read it in the synopsis of the bill:

Synopsis As Introduced
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning the offense of pandering.

House Amendment No. 2
Deletes reference to:
720 ILCS 5/11-16
Adds reference to:
720 ILCS 5/12-36 new

Deletes everything after the enacting clause. Amends the Criminal Code of 1961. Provides that it is unlawful for a person convicted of a forcible felony, a felony violation of the Humane Care for Animals Act, a felony violation of Article 24 of the Criminal Code of 1961, a felony violation of the Illinois Controlled Substances Act, or a felony violation of the Cannabis Control Act to knowingly own, possess, have custody of, or reside in a residence with: (1) an unsterilized dog or puppy older than 12 weeks of age or (2) an adult dog weighing more than 30 pounds. Provides that any dog owned, possessed by, or in the custody of such a person convicted of a felony must be microchipped for permanent identification. Provides that a violation is a Class A misdemeanor. Exempts felons who owned, possessed, or had custody of the dog before the commission of the felony, but these felons must have the dog microchipped for permanent identification and must have the dog sterilized.

But that part of the bill was changed with Amendment 4:

House Amendment No. 4
Changes references in the bill from "unsterilized" to "unspayed or unneutered". Deletes provision that prohibits a felon from knowingly owning, possessing, having custody of, or residing in a residence with an adult dog weighing more than 30 pounds. Deletes provision that permits a felon who owned, possessed, or had custody of a prohibited dog before the commission of the felony to continue to own, possess, or have custody of that dog.

Leaving us with the final bill that I posted at the beginning of the thread. My mistake, I based my comment on the synopsis and didn't read the entire legislative history.

Darn - and it made such good joke material too ;)

For instance ... would there be implied consent for a LEO to weigh your dog, or does he/she need a search warrant ...?


The fact that the poundage issue was even in the first draft says a lot about the mentality of the legislators writing that stuff ..... :rolleyes: :uhoh:
 
Once you and the rest of THR leave, I'll ask the space aliens to eat Daley and then dust Chicago from orbit just to be sure.
Why do you have to wait for THR folk to leave before doing the first one? :confused:

You don't think that law will ever be enforced do you? Imagine the embassessment of the criminals when they are forced to tell their peers in jail; "I'm in for being a felon in possession of an unspayed or neutered dog." :rolleyes:

There are plenty of laws on the books (both state and local) pertaining to dogs, I don't see what this one will accomplish. But yes, there are some good jokes to made of it. :D

Yeah, and imagine the judge and jury trying to keep a straight face during the trial ;)

I wonder what kind of evidence the prosecution would have to present ...? Would they bring the dog into the courtroom and lift his tail to demonstate to the jury that he had not been neutered? :uhoh:

And an old friend of mine from IL wonders why I keep saying the state would be perfectly acceptable if they could cut out Chicago and give it to Canada or China or something. I should show her this article as yet more proof of my point.

But, What if the Dog is a Bitch?

I mean, how can you tell, without a cat scan (I betcha my cat would volunteer) or an exploratory operation, or something? Surgical scars on the bitch's tummy could have gotten there from all kindsa reasons, other than spaying. Will this require round-the-clock stakeout squads around released-felon dog-owner's houses to determine if the boy dogs tend to congregate there?

Easiest way to tell is to leave your toys laying around the house and see how quickly it starts complaining.

So if a guy is convicted of a felony, such as lying to a judge when giving false testimony in a civil lawsuit like, oh, I dunno...., say former President Bill Clinton was, during the Paula Jones lawsuit.

Does this mean former President Bill Clinton would have to give up his dog "Buddy" if he moved to Illinois?

Don't count on any embarrassment at all. Dog fighting culture runs deep in America's black ghettoes and being willing to "jail" for fighting "pits" will only be yet another way for thugs to show their friends how "gangsta" they are.

This is an issue that really raises my ire. I'm a dog lover and just one week ago my girlfriend and I rescued a six month old female pit bull puppy who was pushed out of a SUV at a busy intersection. She had no collar, had worms, and showed obvious signs of having been used as a "bait dog." Thankfully, her sweet personality is likely why she was abandoned and she gets on splendidly with the one year old doberman mix we already had. In fact, I'm off to the vet now to pick her up from her spaying visit.
