I have a question regarding multiple handgun purchase reporting using ATF Form 3310.4 and the Illinois mandated three (3) day waiting period.
I purchased a pistol transferred through my local FFL. He called the info into the IL State Police for my background check on Monday and received the necessary approval. I took possession of the pistol on Friday, easily fulfilling the three day waiting period for a handgun in Illinois. A revolver I bought off GunBroker from a different out of state dealer will be coming in to him soon. We will then go through another background check and another three day 'waiting period'.
My question regards the multiple handgun purchase reporting requirement using ATF Form 3310.4: how does the five (5) business day period that would trigger the 3310.4 report apply here? Would it be five days between him calling in for the background checks, or five days between me taking legal possession of the two handguns, or five days between taking possession of the first handgun and then calling in for the background check on the second one? My dealer is open seven days a week, so I believe that I could have the first background check on Monday, take possession of that pistol on Friday, have the second check on the following Monday, and then legally take possession of the revolver that week on Thursday or Friday. He is not sure, and feels it would be best to have five days between taking the first one home and calling in the info on the second one.
Obviously a later delivery date of the second handgun to my FFL could render this question moot, as they say, but I was curious as to how the law should actually be applied. I searched the ATF site, THR, and the Google but could not find an answer - anybody know?
