Went to ammo attic while in Melbourne working today to grab on of the mosins they had for sale and got denied on my backround check. A little backround- I had my record expunged years ago for some stupid sh@t I did in my early 20s and since then have gotten my ccw and bought more than 20 handguns and rifles over the years and never waited more than 5 minutes for my backround to come back and I always put my social on the form. What really pisses me off was the guy at the shop acted like a d@ck after the call came back. I'm really worried that maybe someone might be messing with my identity or the only other thing I can think of is my little sister has felony warrants in Denver but I haven't seen her in years, this is awful strange.

Could be something like a unpaid ticket... most common kick backs I saw were failure to appear for some dumb ticket.

Contact the FBI. You can get what's called a Personal Identification Number. This is something that is used by people in your position, where you have been denied before for something that you should not have been denied. Basically think about it like this: if your name was Osama Bin Laden, you would probably be denied in error. By using this PIN on your application (next to the SSN section), they can look at your case and see what is going on and why you are being denied.

Don't worry. It's a little bit more paperwork, and it's a pain in the arse, but in the end it will probably make gun purchases more convenient for you anyway.

You can call the NICS and request this Personal Identification Number over the phone. Explain your situation, this is not unheard of and they will know what you are talking about.

Good luck!

Try a different store and make sure they know you have a valid CCW. Start doing credit checks, and keep doing them.

What doesn't make sense to me is that people steal identities to get a clean on, most of them dont ruin their cover with felonies (in which case if they did you would get arrested). Wierd, but id defiantly try it again and if the same thing happens, start makeing the calls to your credit card companies and make sure something isnt happening.

I hope it isn't a ticket, the only one I've gotten in the last 7 years was a reckless driving from an accident when I rearended someone but that ticket was paid the next day and traffic school done within 2 weeks. Whats even more odd is I just bought a mini14 3 weeks ago and picked up my gp100 from a pawn shop that I borrowed on for christmas shopping last week and they did a backround check in order for me to get my gun back.

did the clerk enter all the info correctly? its been known to happen.

Hey, I live in Florida and buy ammo on a weekly basis both on the net and at local stores and have never had to have a background check done. In fact I just bought 250 rounds of Remington PMC .40 caliber FMJ for $67.50 at Walley World and I also did not have to sign for it like you have to do at some gun stores

I would contact NICS and see if this is an appeal issue before I made a fuss at a store that I might want to do business at again.

Do you even have to go through a NICS check in Florida if you have a ccw?

Yes you do. It used to be that the CWL exempted a person from a NICS check, but that is no longer the case in Florida. Those with permits issued on or after November 30, 1998, are subject to FDLE / NICS checks and all permits from before this date are now expired.

i wonder if the clerk entered in the info correctly. one typo, and it is a different person.. or, if the guy didnt like you for some reason, it is not like he has to prove anything. all he has to do is say "sorry, your background check didnt pass. if you raise a stink, he just calls the cops, and then there really is a reason to deny you a firearm.

Home Depot George...Denied or delayed??? I used to get delayed every freaking time. Oh the humanity, it is painful. All I wanted to do was take it home, clean it, hold it, take it to the range, and bring it home to a loving environment.

Damn, the delays were most of the reason I got my permit. Sometimes I think it is easier to adopt a child than buy a gun. (Anybody got an extra $20 for the NRA?)

Denied, I just stopped up at the shop in my neighborhood and talked to the owner, he lives a few houses away from me and I've bought many guns from him the last one 3 weeks ago and he thinks its a clerical error and told me to stop back in a couple weeks and he would run a check for me. Hell he had the mosins for 30 dollars cheaper anyway.

I was delayed once. The owner said it happens alot and come back in 3 days.I went back got the rifle and never knew why I was delayed. What are the reasons for one being delayed?

For some reason, I get delayed all the time. I've found that I get delayed more on the weekends than during the week. I have a feeling that they get a delay and then have to shoot a call over to some other department and possible change it, but that department isn't open on weekends. That's my guess. Anyway, why a person gets delayed comes from two things. 50% of the deceision is based on whether or not they shaved that day and the other 50% depends on how many inches of rain fell in Guatamala last week.

Having a permit bypasses the requirement for background check in many states. At times they just put a hold on you at random...I get denied about 1 out of 4 guns and have to go back and pick it up later. The shop will usually call or they tell you what day you can come get it.

I have about the most common first and last name combination you can imagine, as does my wife, and it's a constant struggle to keep people with similar names out of my credit report and such. I've actually had GOOD false info in my credit report.

I haven't had a problem since I got my permit, other than that, the state BCS closes earlier than NICS, and I was once told, as I tried to do a purchase as the store was closing, that I could either pay the NICS fee and pick it up now, or wait until the next day. I think I got it the next day.

A caller on Tom Gresham's show once told a story, that he has an identical twin brother, with the same first, last, and MI, (meaning, same DOB as well,) with a felony record. It had been a non-stop struggle for years trying to convince the feds that he was a different guy.

That's a delay. Denied means that the NICS said no. The only way to get a gun is to appeal.

I've been delayed in Oregon where a check with the State Police is required for a purchase from a dealer even with a CCW license. One delay went on for almost a year. This was in 2004 and I went through all the hoops and finally learned that an arrest in 1964 in California in which the record was supposedly "sealed" was keeping me from buying the rifle. Interestingly enough, during the many months of the delay on the rifle, I bought two other firearms, a rifle and a pistol and had no problems with the background check. I finally had to re-open the California case and force the record to be cleared in order to complete the purchase. Since 2004 I've been "delayed" two or three times but only for a day or two.
