I'm Suspecious of this Aucion

I've got a 10-5 that has the serial number on the crane, butt of the frame, and on the inside of the frame under the side plate. If this seller isn't interested in proving this firearm is legal, I wouldn't buy it. In fact, if there is any reason to believe the serial numbers have been removed, or appear altered, I wouldn't personally buy it. There are a lot of model 10's out there, I would search for a different one, especially considering this seller appears to be acting fishy.

your bid is a contract

Luckily contract law has you covered. If a serial number being removed makes the gun unownable, then the seller has the obligation to go about having the serial number restored before it can be sold to you. This goes above and beyond any 'as-is' term in the sales agreement. The contract offered by the seller needs to be within the bounds of the law for it to be enforceable.

(same reason you can't sell your kids or cocaine on ebay even if they wouldn't notice the auction and take it down)
 
I sent a message several days ago to the seller that his gun has been altered, and that he will probably have trouble with any buyer later, so he should contact BATF now to have the number stamped elsewhere on the gun with their approval (they can do that). He has left it listed and appears to be ignoring what I told him. He is a licensed dealer, so this is really stupid to ignore.
 
I own at least 8 k frames (just picked up a 1 7/8" model 10 tonight) and all of them have SNs on the butt bottom. It is also funny that the finish on this gun is rough and no restoration work has been started except for the very place the serial number should be. I am going to clean my latest model 10 and 13 purchases tonight and am going to look for numbers inside the grips. They might be some kind of assembly or part numbers which are not serial numbers. He told me he got the gun from the "Suffolk County Police Department" and was told it was the correct serial number - maybe it came from the evidence room. Also I never heard of a county police department BUT I don't know everything. All of this seems very odd.
The only thing I can contribute is that the Suffolk County Police are at least a real entity. Suffolk County is better known as Long Island to most folks...
 
The police seldom concern themselves with the intricacies of the federal law pertaining to guns. The county police probably never contacted BATF about this gun, and so the police treated it like any other gun to be disposed of; in their case, by sale to a dealer. The gun CAN be "fixed", but there is a little red tape involved, and BATF needs to be the one to approve it before it goes back into circulation.
 
S&W model 10 Serial # Issue

I have a early to mid production Model 10 and the only serial # on the gun is on the butt of the gun. NO Duplicate stamping on the frame where the Crane slides in. Only thing there is the gun's model #. This gun is illegal, this is stated from a former FFL Holder. The gun is also not old enough to qualify for purchasing under the C&R License. Lastly, if I'm not mistaken, Gunbroker allows for bid retractions for bidding made on erroneous information. I would look at FAQ's to make sure or write Gunbroker directly. Hope this helped.
