Is my Walther P99 on Cali's approved list?

Hi everyone,

Trying my luck here since the Legal forum doesn't get much traffic...

Kind of confused on how this works. Have a P99 on GB.com and I keep getting this question from California residents that are interested in my gun. The item number on my P99 box says WAP77010, which is the Walther item number for the P99 AS w/ 15rd magazines. However, I'm not selling it with 15rd magazines. I am only including three 10rd magazines. The exact same gun, but with 10rd magazines from the factory has the item number WAP77000, which is on the Cali approved list.

Can I still legally sell WAP77010 w/ 10rd magazines only to a California resident?

Shouldn't a California resident be able to find what's legal in their state? I would imagine it's the buyer's responsibility to stay legal, but living in a free Southern State such as I do this is all Greek to me anyway.

IANAL, but I would think that as long as your ad in GB specifies that it will only ship with the 10-rd mags, you'd be okay.

Actually is isn't the buyer who will decide, it is his FFL who will need to process it. If it isn't a approved model, he'll be sending it back to you.

Correct. Not worth the risk. I decided to just refrain from doing business with California residents.

The model number has to be listed exactly on the California roster. An XD Service 40 S&W in black is not the same gun as an XD Service 40S&W in tan, if they have different model numbers. Yep, stupid California laws. The gun will also no longer be safe if the manufacturer fails to renew their spot on the safe list. The XD is still safe, it was renewed, but the new guns added to the list have to have a magazine disconnect and a labeled loaded chamber indicator to be safe.

You could sell it single shot exempt. If the barrel is over "x" inches long and it only holds one round of ammo, it is exempt from being on the list. This is a very common way to buy higher end guns which are not on the list. People sell kits for this and some shops loan or rent the kits to do the transfer legally.
