Is the M1A rifle banned in any state?

Besides "California legal" I need a fact check please because I told someone that the M1A was on the ban list for so called "assault rifles" but I am not sure what states are doing so.

I know Feinstein's version included it but that probably won't happen.

All this was about me trying to show them a Remington 7400 compared to a M1A
 
Thanks, I was about to tell them NY and Colorado recently banned them but I couldn't find a complete list as their definitions are vague so thanks for stopping me from putting my foot in my mouth although one could still compare a FAL to a Remington 7400 and see how stupid it is...
 
I was talking with my father when the new AWB gun list came out. We thought it was hilarious that our M1A's weren't on the list. Shows the libs complete ignorance on the subject.

Don't know about NY, but there was no AWB here. >15 round mag ban with grandfather provisions, yes, to take effect July 1, unless the Colorado Sheriff's lawsuit kills it. I'm sure the dems would have loved to do an AWB, but they already mortgaged more political capital than they had with the mag ban and UBC.
 
Weeeeeel, let's look at NY first before we go any further.

NY won't let you have any semis with flash hiders or mag capacity, so as of NOW there won't be any new M1As sold in NY. Later, after the SAFE Act is cast aside, you may.
 
Didnt think about the flash suppresor. Should have since they make rifles so much more deadly. Kinda like those shoulder slidey thingies
 
The flash supressor or even a threaded barrel if the flash supressor is removable would make it illegal in CT.

The threaded barrel alone is no longer an "assault" feature.

However, the fact that you can hold the stock somewhere other than with your firing hand is....

So pretty much any new semi-auto detachable-magazine-fed centerfire rifle is banned here.
 
Kind of hard to ban an M1a or mini-14 without banning some of the semi auto hunting rifles that are truly designed to be hunting rifles. As for NY and M1a. It will be for sale. Springfield sells a 5 round hunting magazine. Thus with no effort they can continue to sell in NY. Same thing for mini-14.

Unfortunately, Springfield doesn't currently sell M1as with anything other than a 10rd magazine, so they would not be legal, until Springfield develops a new model number for NY that ships with the 5rd magazine.

The Mini14, on the other hand, can be bought with the 5rd magazine.
 
M1A is not legal in NY right now

there are a couple of reasons why it is not legal in NY right now. It is not because of magazine capacity. When the NY legislature passed this years budget, they included a clause that allows us to buy and possess 10 rnd magazines, but we are not allowed to put more than 7 in them.

The two reasons are;

1) flash hider/Muzzle break, even if it's non-removeable

2) the top dust cover could be considered a heat shield/barrel shroud, even if it only partially encircles the barrel.

It sucks, for now at least. We do hold out hope however that someone will shine some light on the dogs' butt.
 
Is the M1 Garand illegal in NY now?

Not sure. Waiting for a test case. The SAFE act seems to consider en bloc clips to be detachable magazines. At 8rds, they would seem to fall under the ban.

But exospex's point about the handguard being considered a barrel shroud is equally applicable to the M1, so…
 
REALLY - look up the NYSAFE act online

If you actually LOOK at the NYSAFE act,they list all legal and REGISTERABLE [ not illegal - yet ] rifles and pistols too.
 
If you already HAVE one, it is legal, and registerable. If you don't, then you CANNOT legally obtain one unless it is transferred from an immediate family member.
 
The "AWB renewal" Feinstein pushed in 2004, 2006, etc. would have banned the M1A, yes, both by pedigree (semiauto based on a military design) and by features (bayonet lug vs. a 1-feature ban), and of course full-capacity magazines would also have been verboten.

As far as I know, no current state laws ban an M1A in "California-ized" configuration (no bayo lug or threaded muzzle, yes?), although you'd have to find an under-7-round magazine for it to be legal in New York.
