House Bill 2118 Passed by House and Senate
Awaiting Action by the Governor



On Wednesday, May 10, 2006, the Kansas Legislature passed House Bill
2118, a bill necessary for the efficient implementation of concealed
carry for the State of Kansas. HB 2118 was passed by overwhelming
majorities in both the Kansas House and Senate ([House 93 - 24;
Senate 30 - 10.] HB 2118 will now be printed and sent to Governor
Kathleen Sebelius for her signature.

HB 2118 contains several technical and substantive changes to Kansas
law related to the start-up and operation of the application and
licensing process contemplated in the new Personal and Family
Protection Act (Senate Bill 418). HB 2118 also serves to fill-in
certain gaps in the current law * such as insuring the
confidentiality of records of applicants who apply for concealed
carry licenses. Some of the key changes and improvements contained
within HB 2118 include:

- Ensuring confidentiality of the names and other personal
identifying information of applicants for concealed carry licenses.

- Specifying the amounts and methods of payment to be utilized when
an application for a concealed weapons permit is submitted through a
county sheriff's office.

- Providing for the utilization of the Kansas Administrative
Procedures Act when dealing with administrative appeals of licensing
decisions.

- Clarifications on the cooperation between the Office of the
Attorney General and the Kansas Department of Revenue regarding the
production and issuance of licenses to licensees.

- Mandating that information regarding individuals who have been
involuntarily committed for treatment of mental health or
drug/alcohol abuse issues is timely forwarded to the Kansas Bureau of
Investigation so individuals who can not lawfully possess a firearm
are properly identified.

- Clarifying types of school properties and buildings where
concealed firearms will be prohibited.

- Providing a reduced application fee for retired law enforcement
officers to obtain concealed carry permits ($100 for retired officers
versus $150 for other citizens).

Attorney General Phill Kline encourages all interested Kansans to
contact the Office of the Governor to encourage Governor Sebelius to
sign HB 2118 so the Kansas Personal and Family Protection Act can be
put into action as promptly and efficiently as possible.
