im going back home (KS) on leave in a few weeks and last time i was home i noticed a bunch of stores etc having the NO GUNS signs up. how much weight do those hold? I know they dont mean jack here in FL.

also anyone have a link of the KS CCW weapons law,

They hold as much water as they do in Fl, but be careful in the malls. Undercover Police come up behind you and use a wand on you to see if you are packing in the malls. Saw lots of people escorted to the security office last holiday season.
I just stay away from people who dont want my business. Plenty of other places to go.
 
Same thing here

Lots of signs but they don't mean sh*t. I used to go in and tell the proprieter why I wont shop there anymore, but after listening to their excuses and anti-gun nonsense, I now decide to just drive on by to the next shop.
 
In Alabama if the owner if the property/business posts or verbally tells you that guns are not allowed you must comply. Else, you are subject to arrest and your CWP will be revoked!

I think if anyone came up behind me with a wand/club shaped object They would know I had a gun when I drew on them. Or at least took some sort of other action against them. They might get maced or clubbed (if i have my asp)
Would not be a wise move on their part.
 
I wish I was kidding! I am as serious as a heart attack. They claim it is to combat gang-bangers, but they would wand anyone to claim it wasnt racial profiling. Oh yeah ASP is considered same as firearm in Ks according to TPD. Cant say as I agree, that is like bringing a bat to a gun fight.

So they have shown probable cause that you have some metal on you. What do they try next?
 
Isn't wanding someone randomly in the mall illegal searching? As in we have the freedom from search and seizure? I'd through a fit if someone randomly wanded me.
 
That's pretty sick. Next time you go there, find out if there's a sign on the front door (in fine print probably) stating there will be random 'wandings'.

If not, they might have a problem.
 
PY, a private property owner may search you any time they like. Unless they suspect you of shoplifting, in which case they may detain you until police arrive, you are free to show nonconsent by removing yourself from their property anytime you choose.

This is just a general rule of thumb, and YMMV by jurisdiction. They own the turf, they make the rules. Private business policy =/= government regulation.
 
Since these are presumably private cops there's no 4th amendment consideration, however, there may be an "invasion of privacy" tort action that could be brought for random searches. I suspect a court would not be very sympathetic to the argument that in entering the premises you voluntarily gave up your right to privacy. See "Overreaching Contract", "Releases", and "Bailments".

I don't know about FL laws, but in KS you carry into a posted building and it's a class A misdemeanor.

BTW last holiday season we didn't have CCW in KS.

I'd love to know which mall is covertly wanding people in KS. Since he mentions Topeka PD in another post, I'll assume he's talking about West Ridge Mall. WRM is posted and the security is unarmed. I seriously doubt the unarmed rent a cops are dragging armed gangbangers to the office.

Just so you remember CCW wasn't issued till the 1st of Jan, but classes where held as early as September '06, mine was in October. Signs didn't go up until March, after the KSSC issued that the sign must be 6x6 and posted on all entry doors.
However the incident you did not witness from the thriving metropolis of Osage was the arrest/ detainment of my Uncle. He had a folding knife on his belt, under his coat. The WRM security called TPD to frisk him. The anti-gangbanger story was their excuse. He was not charged, but we where asked to leave after they found nothing. The blade was less than 3" so it was considerred a pocket knife.
You might wanna reconsider what you call BS. Also since you go to WRM so much go down by the old cinema6 and tell me why they need the permantently reserved TPD spaces? How do I know they are there? Maybe that is where they walked us out to, to release us.
If you are going to next say it was because I used the term undercover officer instead of civilian clothed security guard dont waste your breathe. Wanding is wanding and that was what I was talking about. Osage City what a joke, my side hurts roflmao.

You have to remember that in Kansas, the CCW act was a long ,hard fought battle with the Anti-gun groups and the Governor who still are trying to find ways around the law. Steve48
 
In Tx, as in most states, a property owner can deny your right to carry by posting a sign; most malls and many other businesses do so.

I've always wondered, if they deny a CHL holder the right to carry (as is their right as the private property owner) do they incur an extra obligation and liability for your protection?

Meaning, if a CHL holder who leaves his pistol at home when he goes to the mall to shop is assaulted, does the property owner stand liable for extra damages since he denied this person his right to self defense, and did not properly defend his guest?

Uh, no, they may not. They can ask you to submit to a search and if you decline they can ask you to leave the property, but you don't give up your rights just by walking onto someone else's property. If you refuse to leave when requested, then you are trespassing. Submit to a search because a property owner thinks they have a "right" to do so? Not no, but H*LL NO! If you're in the public area of the mall and there is no articulable suspicion of shoplifting, all those legal considerations do not apply.

Wanding randomly doesn't even begin to approach PC for a search. They have no way of knowing if they just picked up your cell phone, a legal pocket knife or whatever.
 
And as I've said a million times NEVER go to the Security Office.
Tell them to call a LEO or use your cell to call one.
They then have a choice, stand there and wait for the LEO with you or ask you to leave.
Their choice.

To those who asked if no-carry stores incur liability for rendering you defenseless, the answer I think is no - they owe no "duty" to see that you are protected. No duty = no tort = no damages.

Tactics like that are going to get someone sued, big time. Change, keys, and other assorted metallic items fill my pockets.

However, if they press it, I will set off metal detectors even if I'm stark naked since I have prosthetic implants in both hips and knees (total replacements in all 4 joints). Harassing the disabled without any probable cause will result in a judgment against the police/security company sooner or later.
 
Some of the private security boys are alright but some of them get a nasty power trip from it. If they asked me to go to the "security office"/mall jail I would tell them to back off politely and if they insisted it would quickly become a 'go f*** yourself'. Asking you to leave is one thing, detaining you or searching you without consent is completely different.

Laugh all you want. I used to live in Topeka and still work there. I'll take Osage City over that hellhole all day long.

WRM security is a joke. Don't tell me you really took those clowns seriously and actually allowed them to detain you, did you?
