A SUMMARY OF HOUSE BILL 4962 AS INTRODUCED 6-16-05

HB 4962 Passes House Government Operations Committee
2005/09/20
House Bill 4962 dealing with displaying a plaque on Capitol Grounds honoring the right to bear arms under the U.S. and Michigan Constitution passed with recommendations from the House Government Operations Committee with 5 yes, 1 no, and 1 pass.

The bill would amend the Management and Budget Act to require the Michigan Capitol Park Commission to place on the Capitol grounds, the plaque honoring the right to bear arms under Article II of the U.S. Constitution and Section 6, Article I of the State Constitution as donated by Brass Roots, a private organization, when sufficient money is received to cover the cost of placement.

BACKGROUND INFORMATION:

Constitutional Provisions

Article 1, Section 6 of the State Constitution states: "Every person has a right to keep and bear arms for the defense of himself and the state."

The Second Amendment to the U.S. Constitution states: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed." :)

Never looked at the wording of the state constitution

That's pretty good, I like that it says in no uncertain terms that the right to bear arms is there for individuals to protect themselves.

Michigan is pretty good as far as firearms regulations go, however, there are some pretty weird laws that make no sense in light of the otherwise sensible laws here.

I never got the reason for having to get a pistol purchase permit for some shorter rifles and shotguns. The safety inspection thing is pretty pointless, seems to be a half-@$$ed way to appease people who are afraid of instant background checks or want a registration. I also remember hearing that supressors are illegal here too I think.

But at least we don't have any waiting periods. :cool:

Who/what have been behind this House bill so far anyway? It's something that Brass Roots had been working on exclusively for years, but wonder who else might have helped get this to see the light of day...

To the best of my knowledge, the pistol permit for shorter rifles (non-SBR) isn't even a law, but an AG's opinion. I agree it makes no sense.

The safety inspection would be funny if it weren't an infuriatingly blatant end-run around the state constitution. If the real purpose was safety, why do they need to know anything about the buyer?
 
Actually being able to work the gun would be a more impressive safety check..

like the time they asked me how to open the cylinder on a singl action revolver :rolleyes:
