A Louisville woman shot by a Bullitt County deputy has filed a $1 million suit against the sheriff's department.
Jeanie Longwell, 28, was fleeing from police when the car she was driving was stopped in Bullitt County. Longwell was a suspect in an alleged shoplifting incident in Elizabethtown. She alleges in the lawsuit that Deputy Gary Wilson used unnecessary force when he shot her in the abdomen on Dec. 5, 2001.
The suit, filed recently in U.S. District Court, also names Wilson and Sheriff Paul Parsley as defendants. Parsley declined comment Monday, saying that neither defendant had been served with copies of the suit.
Wilson didn't return calls made to him at the sheriff's department.
According to police accounts, Longwell was shot after refusing to raise her hands as ordered following a chase. While seated in the car, Longwell allegedly reached down and made an upward motion. A large kitchen knife was later found under a seat.
Longwell contends in her lawsuit that she was unarmed, that she had surrendered to police and that Wilson shot her without provocation.
The bullet entered the right side of Longwell's chest and lodged in her abdomen, Riley said.
After the incident, which was investigated by Kentucky State Police, Wilson took 30 days of paid administrative leave and returned to work after undergoing counseling, Deputy Larry Hawkins said.
Longwell is seeking $500,000 each in compensatory and punitive damages, plus attorney fees.
Longwell was taken to University Hospital in Louisville, where she underwent surgery and escaped days later.
Jefferson County police caught up with Longwell a month later, charging her with two counts of theft by unlawful taking over $300, first-degree criminal trespass and being a persistent felony offender.
Longwell pleaded guilty in the Jefferson County case and is serving a 10-year sentence in the Kentucky Correctional Institution for Women.
She is serving concurrent sentences there for crimes in Bullitt County, where she was convicted of wanton endangerment of a police officer, and in Hardin County, where she was convicted of complicity in a robbery with a gun and for being a persistent felony offender.
