Add this to the list of proposals to overhaul the gun industry: Rep. Adam Schiff, D-Calif., says he will introduce legislation this week to roll back legal immunity for gun manufacturers and dealers.

Schiff tells NPR there's no need for the 2005 law called the Protection of Lawful Commerce in Arms Act to remain on the books. That law gave gun makers, gun dealers and trade groups immunity from most negligence and product liability lawsuits. "Good gun companies don't need special protection from the law," Schiff says, "Bad companies don't deserve it."

The company puts warnings in its manual against negligent use.
They sold it to the dealer.
The dealer sold it to the owner.
The owner was killed and had the gun stolen.
The person who killed the owner and stole the gun used it in a tragedy.

I'm sorry, but there is only ONE person I see as being irresponsible here, and it's the person who killed people.

OUTRIGHT LIE.

They are still liable if they make a defective product. They are still liable for negligent distribution practices.

The law only shields them from frivolous lawsuits aimed at deeper pockets when their product is MISUSED.
 
So if this passes, does that mean we can sue automobile manufacturers, tobacco companies, breweries and distilleries, knife makers, Lousiville Slugger, and every other company who has ever made a product that caused harm or death to someone? Or is he simply targeting gun companies on his little crusade?
 
Happens all the time. There are huge numbers of product liability suits settled each year for misusage of various products. A few include, a man who lost fingers on both hands when he used his lawn mower as a hedge trimmer. Manufacturer lost, and lost on appeal, because there was no label on lawn mower warning folks not to use the mower as hedge trimmer.

Another company lost a suit when they sold an old press to a scrap dealer. He, in turn, sold it instead of scrapping it. The subsequent buyer modified the press safety switches, and an operator lost fingers on both hands. The company which sold the press to the scrap dealer lost in court, and on appeal.

The above came right out of my commercial law textbook.

Yes, it happens. Unfairly sometimes, but it happens.
