This is continued from my previous thread "Got Delayed :( - Any help?" http://www.thehighroad.org/showthread.php?p=1614862#post1614862

I found a sample copy of the FFL 4473 form at atf.govhttp://www.atf.treas.gov/forms/4473/index.htm

It turns out I answered question # 13 wrong :cuss: "If you are a nonimigrant alien do you fall within any of the exceptions set forth in Important Notice 6, Exception 6? -yes; -no; -not applicable"

I answered "No" but as a permenant resident/green card holder I should have answered "Not Applicable". Don't know what I was thinking, just misunderstood the question at the time. Needless to say I did not sleep well last night and have been mentally kicking myself since I caught my mistake :banghead:

Called the FFL 1st thing this am, let him know that I realized I had answered #13 incorrectly, and asked if there was anything I could do. He said "No" and that once it's been called in there is nothing I can do to correct it and basically have to wait on the call back.

Everything else on the form should be correct, including my INS A #, which when looked up should show my status as permenant resident.

Anyone have any ideas or knowledge about this?

Any help will be appriciated!

I wouldn't worry about it too much. Many people make mistakes on the 4473, including dealers. You were not trying to falsify anything for the purpose of illegally acquiring a firearm. Besides, the 4473 is merely a form that gets stuck in a file at the dealers store and mostly forgotten.

here we call the TBI for the instacheck. I have never, ever been asked any of the answers to the questions on the front of the form; I don't think they're conducive to any particular outcome.

However, *I* look at them :) You never know when someone will aberrate form the standard "yes, nononononono....." answer list.

Immigrant alien 4473 applications are handled by live operators.
They will ask the dealer how you answered question 13.
They cannot tell the dealer how you should answer the question, but you, as the prospective buyer, are aware of the mistake you made.

The dealer can, if he so chooses, allow you to re-answer the question on the original 4473.
He and you will then initial and date the change.
Once that is done, the dealer must again call FTIP and apply for a new approval number.

Don't sweat this, you aren't the first person nor will you be the last to misunderstand this question.
It can be corrected.

Fair warning, the new 4473 forms will be out by June and these forms are even more involved than the current ones and they will written in a way designed to trip up prospective buyers.

Good Luck and welcome to America.

Nik,

The first time I purchased a firearm as a PR in this country, I made the exact same mistake of selecting "No" as the answer to question 13 on the 4473 (when in fact I should have indicated "Not Applicable"). The FFL found out about it when he was reviewing his paperwork a few weeks after sale, and told me not to worry about it.

That was several years ago, and I have not seen any black helicopters circling my house, and have not been visited by men in black suits and sunglasses, so I am assuming that little error was inconsequential in the grand scheme of things.

I call in FBI background checks all the time for the FFL I work for. Question #13 is not transmitted to the FBI. Just as questions 12a through 12L are not transmitted.

FBI gets:

Name
Place of birth
Birthdate
Height
Weight
SSN (if given)
State of residence
Country(s) of citizenship
Type of firearm (handgun, long gun, or both)

That's all that is transmitted. Response to question 13 (or 12a through L, for that matter) will not have any bearing on the FBI check.

:D :D :D :D :D :D

Thanks to all for the responses and reassurence! Just got the call, spead over there  , and picked up my P-01. They allowed me to change, date and initial the mistake on the form!

I'm extremely happy and extremely relieved!!!

I will take some pics and post them in the next few days.

Whew!

New 4473s? :scrutiny:

Lemme guess:

Have you stopped beating your wife? __Yes ___No
Are you a terrorist? ____Yes ____No
Are you not a terrorist?: ____Yes ____No
Are you a terrorist, but aren't acquiring THIS firearm purely for sporting purposes, and promise not to use it in your upcoming terroristic event ____Yes ____No
(*note: recovery of this specific firearm at a terrorist incident will expose you to additional criminal penalties)

Would you use this firearm to overthrow your tyranical government?

Will this firearm ever have the gun lock unlocked?

Will ammo ever be purchased for this firearm?

Do you belong to any radical organizations or web sites that destort your thinking process, such as The High Road? :D
