Generally speaking, martial law is what you have when there is a *suspension* of civil law, civil rights and habeus corpus. There is case law on the subject - the Possee Comitas act comes to mind. The distinction to make is when the courts cannot function. Where I practice, we have temporarily suspended in-person matters, but much can be accomplished by video for incarcerated persons and we can still file lawsuits, motions, etc. So we are a long way from the courts not functioning.
This went off the rails awfully quickly. If you're wondering what I mean, please be advised that the posts dragging this thread down are now gone. It looked like folks were running out of worhtwhile things to say.
