McDonald SCOTUS Decision -- Master Thread

I assume we will have the decision by 11am ET since that is where the SCOTUS is located, which means us in the central time zone should have the decision by 10am ;)
 
I'll be up bright and early so that I can spread the word....and mock all the anti-gunners on all political sites at their loss. Monday is the anti-gunner's judgement day. Heller will be law of the land.....they're screwed. The Brady's are FINISHED!!!

We can only dream of that.


With a positive win in McDonald it is only the beginning of a long journey and the fight will never be over. We will always have to keep fighting.

My personal opinion (worth every penny paid for it) is that

The SC will mention P+I but more as a placeholder for another day

The SC will state that 2A is incorporated against the states

They will have to define scrutiny

It will NOT be Strict Scrutiny (should be but very unlikely)

It will probably be Heightened Intermediate (akin to the enhanced standard applied to sexual discrimination)

NO LAW WILL FALL ON THE DAY

Each law will have to be individually challenged

As for Daley......there is, on various of the legal blogs and boards about SCOTUS an impression that post Heller, the SC is NOT best pleased with elected officials playing fast and loose with their rulings.

If Daley tries to bugger around with an SC ruling he may find out the hard way what a federal case of deprivation of civil rights under color of law feels like.
 
So 12 midnight to 1 AM here in OZ. I think I'll have to stay up with a bottle of scotch to help me celebrate. Hopefully I won't wake the neighbors with my whooping. :)
 
Anyone who thinks that this will change anything in Chicago is delusional.

No one expects it to change anything in Chicago, but it will impact things everywhere else for a very long time.
 
My prediction:

A 5-4 opinion by Alito finds the Second Amendment is incorporated via the Due Process clause of the 14th Amendment. Thomas joins in the judgement only and writes a concurrence depending on the Privileges and Immunities clause for incorporation. No level of scrutiny is specified because (as in Heller) the majority finds a complete ban on a type of arms commonly used for self defense to be unconstitutional by any type of scrutiny.

Stevens writes for the minority that Chicago's handgun ban does not violate the Second Amendment because it allows the possession of other types of firearms for self defense. Breyer writes a separate concurrence saying that any type of gun ban is OK because guns kill people.

Richard Daley has a complete mental breakdown on national TV and actually does shove a rifle up a reporter's butt.
 
I saw that bit with Hiz Dishonor threatening a man with deadly physical force, and nothing was done, because he is The Daley. He is The Disgusting.
Yes, a positive McDonald will change things in Chicago, but it will take a long time, and many lawsuits until The Mob and The Daley become the Losers.
In the meantime, we keep plugging away.

I'll be the odd duck and claim 6-3 for with one of the weirdos finally "seeing the light" :D but seriously, 5-4 for McDonald.
 
The three remaining from the minority in Heller will vote to uphold the Chicago ban. From their perspective, if it is not an individual right it certainly was not incorporated against the states.

Sotomayor, who joined the liberal bloc after Heller, could join Thomas and Scalia in upholding via Privileges and Immunities
