Michigan court rules in favor of teen who open carried rifle

Sean M. Combs is only 18 but he already knows more about civil rights and Michigan gun laws than the officers who arrested him in April for carrying an antique M1 Garand rifle slung over his shoulder.

The two officers, Rebekah Springer and Gina Potts, saw Combs carrying the rifle in Troy Michigan and demanded his ID. When he refused, noting that he was not violating any laws, he was arrested and charged with Brandishing, Disturbing the Peace, and Obstructing an Officer.

I have written before about the misuse of these “catch-all” charges to chill the rights of citizens and this case appears no different.

I only disagree on one thing - the M-1 Garand is not an antique, just as good today as it was then. ;)
Nice to see he won in court, good one to add to case law. I hope he can then file charges against the officers for violating his civil rights under color of law, give them something to think about.

Edit to add, after reading the article, and noting the picture, I have to wonder...where is her magazine?

Good point. I used the word because it was described that way in the court filings. I LOVE the Garand design ... "Finest battle implement ever designed." :)

I can't tell if there is a small-capacity magazine in the gun that is hidden by the angle and the shadow or not.

Oh if only we had a zoomed in version of that area of the picture. :)
 
Depending on Michigan's sovereign immunity laws, he ought to file a suit for false imprisonment, assault, and battery, to get some of those fees back.
