I guess Sheriff Swope has figured out ho to turn a profit off of this. No application fee, but a user's fee. Brilliant. I think once the other sheriffs figure out that this is a license to print $100 bills they'll jump on board. Can't wait to see how the Post editorializes against this.

St. Charles County sheriff says he has way to cover permit costs

The St. Charles County sheriff plans to collect $100 from each applicant for a permit to carry a concealed weapon and hopes referring to the payments as user fees will avert the need to seek public money to implement the law.

In what would be a distinction without a difference to applicants, calling the $100 payment a user fee instead of an application fee would let the county use the money to cover all its costs of implementing the law, Sheriff Tim Swope said Friday.

The law requires sheriffs to use the $100 application fee for training and equipment only. Swope said calling the payment a user fee would also let him use the money to pay clerks needed to handle applications, cover the cost of an applicant's fingerprint check and meet other related expenses.

"As a county, we can charge a user fee for our costs," Swope said.

Under an "extremely tentative" plan, St. Charles County will begin accepting applications March 20, Swope said. Initially, people desiring concealed carry permits could file applications during the day Saturdays and evenings Monday through Thursday.

Referring to the $100 payment as a user fee appeared Friday to be unique among sheriffs in Missouri. Swope said the St. Charles County arrangement needs a county ordinance to become effective.
Money collected would be used to pay clerks overtime, the sheriff said.

"We're not taking resources from the street or anywhere else," he said.

Calculations show that the $100 user fee "give or take a few dollars" should cover all of the county's expenses in processing applications, Swope said.

He said the plan was worked out this week in discussions with County Executive Joe Ortwerth, County Counselor Joann Leykam and County Council Chairman Doug Funderburk.

The sheriff said he hopes each application can be taken in 30 minutes to an hour. He said he expects a rush of applications, at least initially.

"We want everyone to be patient," Swope said.

Maybe Shefiff Matlock, here in Christian County, MO, will figure something out like this.

Ten miles north of me in Greene County (Springfield), I believe that the Sheriff said that he will take applications starting Monday, the 15th of March 2004.

But, on the downside, I heard from my FFL today that somebody went sheriff shopping and filed again to have the law put on hold. I believe that the alleged sheriff is from Montauk County (I have not yet verified any of this, though).
 
I still don't understand how they could possibly claim to need $100 to cover expenses, "give or take a few dollars."

What in the world does it cost to fingerprint someone in Missouri? What are they doing, tracing the ink onto each individual ridge on your finger with a MontBlanc pen? Do they offer complimentary coffee bar while you fill out the forms?

Seriously, how are they getting those estimates? Are they estimating that they need to hire another person to do this CCW processing?

And what's up with having to apply on Saturdays and evenings? They'll turn you away if you apply at 10:00 a.m. on a Monday morning? :confused:

They are going to turn a heck of a profit on this. Most agencies do this type of thing for other purposes for a token fee. Ours charges the outragous sum of $3.00 to take fingerprints for a person applying to work at a bank or some other financial institution. Records checks for armed forces recruiters are free, but the county charges $1.00. The whole idea that some anti CCW sheriffs are saying that they can't cover expenses for $100 a pop is ridiculus.

What chaps my butt is that personnel and operating costs are supposed to be figured into the annual budget. The clerk would be there drawing a check whether anyone comes in or not. This is just a ripoff.
 
If it takes 30 min to an hour to take the app. Plus the clerk work, computer time, record checks and other things that I may not be aware of, then a $100.00 "handleing fee" isn't unreasonable. It also makes the Hancock argument mute.

You can argue about who is going to cover this cost. I see it as reasonable to pay it out of my pocket.

If the sherrif of Montauk Co falls in with the anti-gunners he will be out of work in short order.

Dem's some good ole' boys in dat part of de woods.
