APPROVAL OF THE AGENDA
Council Action: A motion was made by Councilmember Brouillet, second by Councilmember Eckerson, to approve the agenda as submitted. The motion passed 7-0.

CITIZEN COMMENTS
Ralph W. Smith, 512 2nd Avenue NE, Puyallup, resident of Puyallup for 85 years explained that he spoke to Council last year about banning fireworks and that he can not leave his house on the Fourth of July because of the danger from fireworks around his house. He asked if something could be done about the noise, pollution and danger caused by the fireworks, and asked that the Council prohibit their use. He discussed concerns with speeding along 2nd Avenue NE and stated he has yet to see any police officers patrolling for speeders. He asked if anything could be done to insure that the large Sequoia trees located in the city in various locations will be protected. Mayor Turner explained that although the Council has the authority to ban fireworks, it had recently been considered and was not approved.
Doug Skelly, 9308 44th Street Court East, Edgewood, explained that his property is located to the north of the future development of a 350,000 square feet warehouse that will be inside the Puyallup city limits. He noted that Edgewood has zoned this area SF-3 (three single-family units per acre) and he was concerned about the affect this type of development would have on a residential area. Part of the development proposal includes a 900 ft. long wall that will be 40 ft. high. He suggested a natural buffer be required by Council to separate the residential from the industrial zones.
Margaret Skelly, 9308 44th Street Court East, Edgewood, added commented that they have fought hard to keep their property zoned at SF-3 and she is very concerned about the proposed development. She urged Council not to allow this type of development. She noted that she is on the Edgewood Planning Commission and will be bringing this matter to their attention.
Mr. Utterback explained that the city had just received the application for the project and had just begun review of the project.
Mark Walsh, 1302 Puyallup Street, spoke about the proposed fee for rental properties if the EMS and Ambulance Transport Utility was implemented. He objected to the proposed fee stating that it was inequitable and would decrease the value of his property, and asked Council to consider an EMS Levy rather than the ambulance utility.
George Sessions, 2807 6th Street SE, spoke about the 5th/7th Street SE connector and explained that he will continue to address Council until something is done about what he considered speeding and unsafe conditions on the street. Again, he requested the speed limit be lowered to 25 mph. He said that he spoke with traffic engineer Marlene Ford who says the current road meets the regulations, but he feels that there is a much higher liability to the city with the current speeds. Mr. Bacon responded that Council will discuss the traffic study at the study session scheduled for August 9, 2004. Mayor Turner spoke in favor of lowering the speed to 25 mph.

Bobby Williams, (address deleted so you all don't try to come steal my guns! j/k), read from a handout that he gave Council, regarding the Puyallup Municipal Code 9.20.050 Fireworks, firearms, and weapons; and the RCW 9.41.290 State preemption. “The state of Washington hereby fully occupies and preempts the entire field of firearms regulation within the boundaries of the state. Such laws and ordinances shall not abridge the right of the individual guaranteed by Article I, Section 24 of the state constitution to bear arms in defense of self or others; restricting the possession of firearms in any stadium or convention center, operated by a city, town, county, or other municipality, except that such restrictions shall not apply to: Any pistol in the possession of a person licensed under RCW or exempt from the licensing requirement of the RCW.†He explained that the state ruling overrides the municipal code and asked Council to repeal that portion of the PMC addressing this issue.
Adam Jackson, 2310 McCormick Ct SE, explained that Puyallup firefighters spent approximately $7,000 of their own funds on the last EMS levy campaign and asked for Council support if they choose to go for another EMS levy.

yeah! now to see if they actually DO change the municipal code.....
actually, they kind of hodgpodged together my statements. it didn't quite go like that, but close enough to get the point across i guess.
next step will be to change the Pierce county ordinance which is very similar.
