Nashua, NH police against CCW? ND at a Wal-mart...

My random thoughts...

Guy is definately in need of some common-sense injections regarding carrying his glock. That COULD have been much worse.

I think the legal harassment was BS, and searching his appt was BS. Like someone said - fishing expedition. There was no intent to harm anyone, and he shouldn't be treated like a criminal.

I hope NH doesn't turn into MA, I'd like to move there!

There are no restrictions on "handicap" stalls. If they are empty, they can be used by anyone. Obviously, the courtious thing would be to choose the non-handicap stall, but if it the only stall available, too bad, I'm going! Besides, a lot of places only have one stall and it is configured for hadicap access. What am I supposed to do then? I know the Wall-Mart in Bennington VT is like that.

In regards to the home serch as a function of bail:
They were probably looking for more guns.
Why is that relevant to the situation? He's not a convicted felon - is there some legal reason that he can't own a firearm while on bail?

including parking one's posterior in a handicapped stall, is reserved for handicapped folks

Sidetrack here but that's not right, not even slightly.

ADA (Americans with Disabilities Act) requires public places to PROVIDE handicap accessible facilities but those facilities are NOT reserved ONLY for the handicapped.

Back to your regularly scheduled programming.

You shoot into the floor of a place like Wal-Mart, where it's concrete, you've got good chances of a ricochet. Shoot into the ceiling, it may stop before it leaves the roof.
Of course, you could avoid NDs by keeping your finger off the triggerkl. Any Federales get felony counts against them when their guns go off?

MA/NH

Pilgrim: You're right on the money. Too many LEO's do see firearms as condition of employment, rather than an enumerated right.

EddieCoyle: I am much younger than you, but I am aware of how MA has changed. (I have been educated in the times of MA by relatives and some first hand experience.) There are some pro-freedom people in MA, but they are outnumbered by leftists, who are spreading to NH & VT.

A lot of those department stores also put the office above the restrooms to save as much high ceiling floor space as possible. At the one I worked at there would have been at least 3 people in the room above that restroom.

I seem to remember a cop in Virginia killing a man who was accused of running a bookmaking operation in that man's front yard with a ND. I also remember no criminal charges being filed...

It was ajoke

Carknocker:

It was ajoke...get it, parking one's butt V. parking one's car. :D

Good thing this is NH, not Ohio. Here he would gotten in bigger trouble for even carrying a gun into a public business, even if he had a CC permit.

Guy made a mistake, sure.

What I don't understand is what authority a private business has to detain you. Sure the guy complied...

Having a hard time looking at this from his point of view, but Glocks do have relatively light triggers, this is not the first and won't be the last time this happens with a Glock. If that had happened to me, my first priority would be to get out of there as fast as possible

Got another walmart story for all ya'll. Back when I first started carying I went into the walmart bath room to take a piss. There was already a county deputy at he next stall to the left. Needless to say, I was a bit nervous. I took my stance, cracked my belt/fly and my pant proceeded to go rocketing to the floor. The deputy looks over at me, looks down and starts to chuckle. His comment was, "don't ya hate it when that happens." And that was the full extent of the laws participation in my most embarassing moment.

Light trigger on a Glock? Keep your stupid and I mean stupid finger out of the trigger gaurd. Is that so hard to do or train yourself to do?

The guy in Wal-Mart was stupid but that does not justify a FELONY charge!

The lower part of NH has been contaminated by MA uh being nice I will call them MA. That is not what they are called in NH.

My town in Mass has avoided that sort of thing by enforcing stricter zoning rules and by the town buying up open land when it comes on the market. Sure, it makes it a bit more expensive to live here, but so far anyway, the townspeople have voted in favor of it.

Of course typical Socialist Attitude.

Anyone know if the guy was heard to say; "I'm the only one professional enough to carry this Glock..."

When asked why he felt the need to carry a concealed handgun at Wal-Mart, Masterson replied: “Well, I have the right to bear arms, you know.”

its not clear if the police asked this question to him or if it was a seperate statement by the article writer.
but the best answer to the officer would have been "well, you brought yours in"

Last year a Wilmington Policeman (11 year veteran) foolishly unholstered his loaded P99 while doing security work at a PAL league game where he was working security and passed it around to kids who wanted to see it, he forgot to remove the round from the chamber and had a ND blowing a hole in the floor and striking one of the students with jacket fragments. 4 years ago a Philadelphia police woman did the same thing at her child's school and wounded a kindergarden student with the riccocheting fragments.

Both officers were briefly suspended with pay, and went back to work, no charges filed, since it was an accident. Nevermind that unholstering for show and tell is against the rules in both departments.

No doubt some police officer has a ND every week somewhere in the USA, but most incidents seldom make the news.

There is certainly a double standard.

I agree I believe that the police/prosecution was hoping to find something extra they can charge him for, since a decent defense attorney should be able to start pulling Cop ND's out the wazoo, including a number where people were hurt or killed, where the officer in question was never charged, or even disciplined with more than paperwork.

How much do you want to bet that he ends up plea-bargaining it down to some sort of minor misdemeanor, maybe loose his CCW for a year or so?

Dangerous Dave--

It's permissible to carry in public businesses in Ohio with CCW. There are exceptions, for example, bars and restaurants where alcohol is served, government buildings, schools, and businesses that post No-Gun notices at the door. Wal-Mart is not posted, so it's permitted. However, if enough of these idiots shoot off their guns in their stores, don't be surprised if they start posting.
