I have a number of firearms (Sig556, Browning A-bolt, XD 45C, XD40SC, Sig 239/40SW, LCP, Keltec P11/9, SW 625) that I'd like to sell FTF but an unsure of the process. I would appreciate it if I could have a member provide an honest summary of the process needed in NC.

Thanks

Here is my understanding.

Rifles you are good selling to anyone FTF as long as you are "reasonably sure" that they are not a prohibited person. I ask them and if they are young ask for ID showing age.

Pistols become an issue. To legally sell a pistol in NC you have to either sell it to a NC CCW permit holder or receive a "pistol purchase permit" from the buyer for each pistol you sell. You can also do it at any gun store although they will likely charge a transfer fee of around $25. The dealer will require the person receiving the pistol to have the same requirements.

As far as I understand, a FTF transfer requires the purchaser to be over 18. The sheriff may require them to be over 21 for a pistol purchase permit.

for rifles and shotguns we write upa bill of sale with the gun serial numbers and both parties drivers license numbers. make a copy for each person and have both people sign both copies

Here in Gastonia we exchange DL numbers and form of payment for the firearm (rifle, shotgun or handgun). No purchase permit necessary in NC for FTF sales..

Sorry, but as I understand and read the law that is not the case.

"As always, anyother transfer between private individuals is also governed by North Carolina's pistol permit laws.
Under North Carolina law, it is unlawful for any person, firm, or corporation to sell, give away, transfer, purchase, or receive, at any place in the state, any pistol, unless the purchaser or receiver has first obtained a license or permit to receive such a pistol by the sheriff of the county where the purchaser or receiver resides, or the purchaser or receiver possesses a valid North Carolina-issued

concealed carry permit. This requirement to obtain a permit prior to the transfer of a pistol applies not only to a commercial transaction, typically at a sporting goods store, but also between private individuals or companies throughout North Carolina." N.C. Gen. Stat. § 14-402(a)

daehawc summed up the law perfectly.

For handguns, all you need to see is a pistol purchase permit or CHP. For long guns, reasonable certainty that they are of age and not a felon.

Receipts, bills of sale, Driver's License numbers, CHP photocopies, filing/keeping the Pistol Purchase Permit, and other things are often done, but not required. I love killing the paper trail on a gun as a statement of principle.
